LaMonica McIver faces felony assault charge in conflict at ICE facility, court filing shows"},"content":{"rendered":"<div>\n<p>New Jersey Rep. <a>LaMonica McIver<\/a> is <a href=\"https:\/\/www.politico.com\/news\/2025\/05\/19\/new-jersey-congressmember-assault-00357934\" target=\"_blank\">facing a felony charge of assaulting a federal officer<\/a> for allegedly pushing a pair of unnamed Homeland Security agents during a scuffle that broke out earlier this month as three House members were trying to visit an immigration detention center in Newark, New Jersey, a court filing released Tuesday shows.<\/p>\n<p>The <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.njd.569115\/gov.uscourts.njd.569115.1.0.pdf\" target=\"_blank\">criminal complaint<\/a> filed in U.S. District Court in Newark alleges McIver \u201cslammed her forearm\u201d into one agent and \u201cforcibly\u201d grabbed him. The Democratic congressmember is also accused of using \u201ceach of her forearms to forcibly strike\u201d another officer, according to the complaint, which includes multiple photos from video cameras worn by officers, as well as others mounted outside the facility.<\/p>\n<p>The complaint was presented to U.S. Magistrate Judge Stacey Adams on Monday evening, shortly before New Jersey\u2019s interim U.S. Attorney, Alina Habba, <a href=\"https:\/\/x.com\/usattyhabba\/status\/1924615111198576645?s=46\" target=\"_blank\">announced the charge on X<\/a>, escalating a confrontation between the political branches. Habba also agreed to drop the pending trespass charge against Newark Mayor Ras Baraka, a Democrat who is also running for governor. <\/p>\n<p>The charge against McIver carries a maximum statutory punishment of eight years in prison, although defendants are typically sentenced in accordance with federal guidelines that usually result in sentences well below the maximum.<\/p>\n<p>Under federal court rules, prosecutors will have 30 days to get a grand jury to obtain an indictment of McIver.<\/p>\n<p>The court filing was released hours before a House subcommittee <a href=\"https:\/\/www.politico.com\/news\/2025\/05\/20\/democrats-ice-new-jersey-hearing-00358193\" target=\"_blank\">planned to hold a hearing examining<\/a> the \u201cthreats to ICE operations.\u201d The panel is led by fellow New Jersey Rep. <a href=\"https:\/\/directory.politicopro.com\/member\/196450\" data-person-id=\"196450\">Jeff Van Drew<\/a>, a Republican. He referred to the incident in Newark, saying that \u201cwe\u2019re going to go into \u2026 the actual scuffle itself.\u201d<\/p>\n<p>The charge follows a May 9 visit by McIver, along with her colleagues Reps. <a href=\"https:\/\/directory.politicopro.com\/member\/424340\" data-person-id=\"424340\">Rob Menendez<\/a> (D-N.J.) and <a href=\"https:\/\/directory.politicopro.com\/member\/196528\" data-person-id=\"196528\">Bonnie Watson Coleman<\/a> (D-N.J.), to a newly opened Immigration and Customs Enforcement facility in Newark that <a href=\"https:\/\/www.politico.com\/news\/2025\/05\/09\/new-jersey-mayor-ras-baraka-ice-00339287\" target=\"_blank\">unfolded in a tussle<\/a> and resulted in the arrest of Baraka.<\/p>\n<p>McIver, who has maintained her innocence and denounced the charges as political, is likely to be summoned to appear before a magistrate judge in federal court in the coming days to be formally advised of the charges.<\/p>\n<p><video id=\"https:\/\/bluelightnews.com\/wp-content\/uploads\/2025\/05\/main.mp4\" title=\"House members, protesters clash with authorities at New Jersey ICE facility\" data-description=\"lead image\" poster=\"https:\/\/cf-images.us-east-1.prod.boltdns.net\/v1\/static\/1155968404\/103f97cd-292c-4b90-82dc-0c3ea593e2a6\/c9c8030b-8b14-45c8-9a7f-5d3d132dfe24\/1280x720\/match\/image.jpg\"><source src=\"https:\/\/bluelightnews.com\/wp-content\/uploads\/2025\/05\/main.mp4\" type=\"video\/mp4\"><\/video><\/p>\n<p>The charging document gives a fresh, written account of the day\u2019s events from Department of Homeland Security special agent Robert Tansey.<\/p>\n<p>Tansey gave a new account about how Baraka was able to enter a gated area at the detention facility. Baraka said he was invited in. Tansley said the mayor was able to enter \u201cbecause the guard was under the impression that the Mayor was part of the Congressional delegation.\u201d<\/p>\n<p>Baraka was eventually asked to leave the gated area and told he would be arrested.<\/p>\n<p>At the time, Blue Light News witnessed McIver and Watson Coleman appearing to mediate a negotiation between an agent and Baraka inside the gated area. According to Tansey, McIver and the other members of Congress \u201csurrounded the Mayor and prevented [authorities] from handcuffing him and taking him into custody.\u201d<\/p>\n<p>Baraka eventually left the gated area. The three members of Congress who were still inside the gate headed back toward the facility.<\/p>\n<p>\u201cWe will be your eyes and your ears and we will report to you, mayor,\u201d Watson Coleman told Baraka, at a point where the situation seemed to have been defused.<\/p>\n<p>Moments later, Menendez came back across the parking lot to warn Baraka that he could still be arrested. Menendez would later say that he\u2019d witnessed an agent inside the fenced area talking on the phone with someone who told the agent to arrest Baraka. McIver gave a similar account.<\/p>\n<p>Authorities approached Baraka to arrest him, setting off a scrum. Tansey said McIver \u201churried outside towards the agents and attempted to thwart the arrest as others yelled \u2018circle the mayor.\u2019\u201d<\/p>\n<p>Tansey said McIver and others circled Baraka in a \u201chuman shield\u201d to prevent the arrest. He said her attempts to \u201cthwart the arrest\u201d included allegedly slamming her forearm into and grabbing one agent and using her forearms to forcibly strike another.<\/p>\n<p>Menendez said in a Monday night statement that, having witnessed everything firsthand, &#8220;I strongly believe that the administration should be apologizing to Rep. McIver, not arresting her on unprecedented, politicized charges.&#8221; The day of the incident, Menendez said that \u201call of us were touched\u201d by federal authorities and said McIver had been shoved in what he called an \u201cassault.\u201d<\/p>\n<p>McIver told reporters Tuesday morning that she is \u201c<a href=\"https:\/\/x.com\/hailey_fuchs\/status\/1924829381190418839?s=46&amp;t=B3UjAIhhKdVIAMCHIlm1tg\" target=\"_blank\">looking forward to my day in court<\/a>.\u201d In a BLN interview on Tuesday, prior to the charging document becoming public, McIver called the Trump administration\u2019s actions \u201cpolitical intimidation.\u201d In response to a question about if she had attempted to negotiate a plea deal, McIver said she is \u201copen to having conversations\u201d but won\u2019t \u201croll over and stop doing my job.\u201d<\/p>\n<p>\u201cThe Justice Department and Alina Habba wanted me to admit to doing something that I did not do, and I was not going to do that,\u201d McIver said.<\/p>\n<p><i>Madison Fernandez contributed to this report.<\/i><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Jersey Rep.
