{"id":8932,"date":"2025-05-07T06:21:11","date_gmt":"2025-05-07T06:21:11","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/the-case-against-trumps-alien-enemies-act-invocation-is-mounting\/"},"modified":"2025-05-07T06:21:11","modified_gmt":"2025-05-07T06:21:11","slug":"the-case-against-trumps-alien-enemies-act-invocation-is-mounting","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/the-case-against-trumps-alien-enemies-act-invocation-is-mounting\/","title":{"rendered":"The case against Trump\u2019s Alien Enemies Act invocation is mounting"},"content":{"rendered":"<div>\n<p>Last week, a Donald Trump-appointed judge in Texas deemed the president&rsquo;s invocation of the Alien Enemies Act <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/alien-enemies-act-invocation-unlawful-rcna204232\" target=\"_blank\">&ldquo;unlawful.&rdquo;<\/a> Blocking further deportations of alleged Venezuelan gang members under that law, U.S. District Judge Fernando Rodriguez Jr. said the invocation didn&rsquo;t meet the legal standard demanded by the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-boasberg-alien-enemies-act-deportations-rcna197253\" target=\"_blank\">1798 wartime law<\/a>.<\/p>\n<p>In doing so, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.2000771\/gov.uscourts.txsd.2000771.58.0_1.pdf\" target=\"_blank\">Rodriguez emphasized<\/a> that he wasn&rsquo;t delving into Trump&rsquo;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua\/\" target=\"_blank\">factual assertions<\/a> underlying his invocation, including the claim that the Venezuelan government directs the gang Tren de Aragua&rsquo;s actions. Even if those claims were true, the judge found, the government still didn&rsquo;t meet the legal standard, because the alleged conduct didn&rsquo;t qualify as an &ldquo;invasion&rdquo; or &ldquo;predatory incursion&rdquo; under the law.<\/p>\n<p>But a newly declassified memo undercuts that factual claim, too, leaving both the legal and factual basis of Trump&rsquo;s invocation wanting.<\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/2025\/05\/05\/us\/trump-venezuela-gang-ties-spy-memo.html\" target=\"_blank\">reported that<\/a> the memo, released Monday, &ldquo;confirms that U.S. intelligence agencies rejected a key claim President Trump put forth to justify invoking a wartime statute to summarily deport Venezuelans to a prison in El Salvador.&rdquo; The Times reported that <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/32f71f10c36cc482\/d90251d5-full.pdf\" target=\"_blank\">the memo<\/a> &ldquo;states that spy agencies do not believe that the administration of Venezuela&rsquo;s president, Nicol&aacute;s Maduro, controls a criminal gang, Tren de Aragua. That determination contradicts what Mr. Trump asserted when he invoked the deportation law, the Alien Enemies Act.&rdquo;<\/p>\n<p>This latest news comes as another judge, in New York, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.640153\/gov.uscourts.nysd.640153.84.0.pdf\" target=\"_blank\">ruled against<\/a> Trump&rsquo;s invocation on Tuesday. Meanwhile, lawyers for people already sent to that Salvadoran prison <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.278436\/gov.uscourts.dcd.278436.102.1.pdf\" target=\"_blank\">are seeking<\/a> their return in a case out of Washington, D.C., while the Supreme Court could weigh in at any time in yet another case on the subject (a different one <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/24a1007.html\" target=\"_blank\">from Texas<\/a>).<\/p>\n<p>Ultimately, the justices could need to resolve the underlying legality of Trump&rsquo;s invocation once and for all.
