It sounds like an odd question at first, given the government&rsquo;s stubborn stance in this case and others. But there was a mysterious development raising the possibility. Plus, <em>yet another<\/em> judge ordered <em>yet another<\/em> person&rsquo;s return from El Salvador, all while lawyers for scores of people held in that nation&rsquo;s notorious terror prison press a new claim for &ldquo;urgent&rdquo; relief.<\/p>\n<p><strong>Ahead of the mystery move<\/strong>U.S. District Judge Paula Xinis blasted the government&rsquo;s &ldquo;willful and bad faith refusal to comply with discovery obligations.&rdquo; (Discovery is the information-gathering process during litigation.) In <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.100.0_2.pdf\" target=\"_blank\">an order<\/a> Tuesday, Xinis assailed the Trump administration&#8217;s &ldquo;continued mischaracterization&rdquo; of the Supreme Court&rsquo;s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a949_lkhn.pdf\" target=\"_blank\">demand<\/a> to facilitate Abrego Garcia&rsquo;s release and &ldquo;to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.&rdquo; She told officials to answer his lawyers&rsquo; questions by Wednesday evening.<\/p>\n<p><strong>But then a sealed motion appeared <\/strong>Wednesday<strong> <\/strong>on Xinis&rsquo; docket. It was from the government, seeking a weeklong pause in the discovery fight. A sealed response from Abrego Garcia&rsquo;s lawyers followed, and Xinis granted the motion. Crucially, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.103.0_2.pdf\" target=\"_blank\">she noted<\/a> the pause was &ldquo;[w]ith the agreement of the parties.&rdquo; The details of the filings weren&rsquo;t public, so we don&rsquo;t know what each side said. But why would Abrego Garcia and Xinis agree to any delay if it&rsquo;s not to get him back? <a href=\"https:\/\/www.courtlistener.com\/docket\/69777799\/abrego-garcia-v-noem\/\" target=\"_blank\">The docket<\/a> has been silent since Wednesday. <\/p>\n<p><strong>Meanwhile, <\/strong><strong><em>another <\/em><\/strong><strong>judge ordered the return<\/strong> of <em>another <\/em>man from El Salvador. U.S. District Judge Stephanie Gallagher <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-judge-cristian-el-salvador-abrego-garcia-rcna202759\" target=\"_blank\">sided with<\/a> a 20-year-old going by &ldquo;Cristian&rdquo; in court papers who, she said, was wrongly sent to that country before his asylum application was processed. &ldquo;Thus, like Judge Xinis in the <em>Abrego Garcia<\/em> matter, this Court will order Defendants to facilitate Cristian&rsquo;s return to the United States so that he can receive the process he was entitled to,&rdquo; Gallagher <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.457483\/gov.uscourts.mdd.457483.253.0_2.pdf\" target=\"_blank\">wrote<\/a>.<\/p>\n<p><strong>But what about all the others shipped to El Salvador<\/strong> and loaded into a notorious prison without due process? Lawyers are <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.278436\/gov.uscourts.dcd.278436.102.1.pdf\" target=\"_blank\">now seeking<\/a> their return, too. The motion is pending before U.S. District Judge James Boasberg, who <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/judge-boasberg-trump-criminal-contempt-deportation-rcna200064\" target=\"_blank\">found probable cause<\/a> last week to hold Trump officials in contempt, which the administration is currently <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.41957\/gov.uscourts.cadc.41957.01208733712.0_1.pdf\" target=\"_blank\">trying to appeal<\/a>.<\/p>\n<p><strong>Speaking of Trump v. The Judiciary on immigration, <\/strong>his administration just escalated the war by <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/04\/25\/wisconsin-judge-arrest-fbi-ice-immigration-enforcement\/\" target=\"_blank\">arresting<\/a> a Wisconsin state court judge whom the federal government <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wied.111629\/gov.uscourts.wied.111629.1.0.pdf\" target=\"_blank\">alleged<\/a> obstructed an immigration arrest. &ldquo;No one is above the law,&rdquo; Donald Trump&rsquo;s attorney general, Pam Bondi, <a href=\"https:\/\/x.com\/AGPamBondi\/status\/1915799429455516128\" target=\"_blank\">said<\/a> upon the arrest of Milwaukee Judge Hannah Dugan. A statement on Dugan&rsquo;s behalf said she &ldquo;has committed herself to the rule of law and the principles of due process for her entire career&rdquo; and &ldquo;looks forward to being exonerated.&rdquo;<\/p>\n<p><strong>Elsewhere in Law &amp; Order<\/strong>three more federal prosecutors from the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/eric-adams-alina-habba-alien-enemies-act-deadline-newsletter-rcna199777\" target=\"_blank\">Eric Adams boondoggle<\/a> resigned rather than <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/prosecutors-resign-corruption-case-new-york-mayor-eric-adams-rcna202419\" target=\"_blank\">betray their oaths<\/a>. Deputy Attorney General <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-gag-order-trial-judge-merchan-todd-blanche-rcna148977\" target=\"_blank\">Todd Blanche<\/a> wanted them to admit wrongdoing in refusing to dismiss the case for Trump&rsquo;s political aims, but they declined to &ldquo;confess wrongdoing when there was none.&rdquo; And one of the president&rsquo;s latest clemency grants for a loyal supporter is memorably captured in The Associated Press&rsquo; <a href=\"https:\/\/apnews.com\/article\/trump-pardon-michele-fiore-nevada-fraud-cf56ef8b302b8111e47cf52d5a606d19\" target=\"_blank\">headline<\/a>: <em>Trump pardons Nevada politician who paid for cosmetic surgery with funds to honor a slain officer.<\/em><\/p>\n<p><strong>The Supreme Court enters its final full week <\/strong>of hearings <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_calendars\/MonthlyArgumentCalApril2025.pdf\" target=\"_blank\">Monday<\/a>after considering <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-religion-school-lgbtq-mahmoud-taylor-rcna202223\" target=\"_blank\">a request this week<\/a> from parents to keep their elementary school kids away from instruction involving LGBTQ-themed books. The high court majority <a href=\"https:\/\/www.nytimes.com\/2025\/04\/22\/us\/politics\/supreme-court-lgbtq-books.html\" target=\"_blank\">sounded ready<\/a> to side with the parents&rsquo; religious appeal, while another big argument is set for Wednesday over a bid for the nation&rsquo;s first public religious charter school <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-religion-schools-oklahoma-maryland-rcna189406\" target=\"_blank\"> internationality fact life<\/a>. That would typically be the final hearing of the term, but remember that the justices set a rare May 15 hearing <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-birthright-citizenship-injunctions-hearing-rcna199780\" target=\"_blank\">on birthright citizenship<\/a>too.<\/p>\n<p><strong>As always, emergency appeals<\/strong> will keep the court busy on immigration and more, with the administration this week adding another urgent filing <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/transgender-military-ban-trump-supreme-court-enforce-rcna202826\" target=\"_blank\">seeking to enforce<\/a> its transgender military service ban. We could learn next week if the court wants to help Trump out on that one &mdash; so far in his second term, his record is mixed at the court.
