Any similar filings that come his way will also be rejected, Bruck added.<\/p>\n<p>&ldquo;Since this decision is likely to result in further litigation, I must refrain from discussing specific details about the situation,&rdquo; Bruck said in a statement.<\/p>\n<p>Carpenter was <a href=\"https:\/\/www.msnbc.com\/top-stories\/latest\/texas-sues-new-york-doctor-mailing-abortion-pills-rcna184240\" target=\"_blank\">sued by Paxton&rsquo;s office<\/a> in December for prescribing abortion pills via telemedicine to a patient who lives near Dallas. Paxton accused Carpenter of violating Texas law by practicing medicine in the state without a local license. Last month, a Texas judge <a href=\"https:\/\/www.msnbc.com\/top-stories\/latest\/new-york-gov-hochul-abortion-doctor-louisiana-extradition-rcna192214\" target=\"_blank\">ordered Carpenter to stop prescribing abortion pills <\/a>to patients in the state and issued her a more than $100,000 fine.<\/p>\n<p>Paxton, in a statement on X, said that he was &ldquo;outraged&rdquo; over the county clerk&rsquo;s refusal to allow his state to enforce the judgment against Carpenter, whom he called &ldquo;a radical abortionist illegally peddling dangerous drugs across state lines.&rdquo; (<a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/04\/01\/health\/abortion-pill-safety.html\" target=\"_blank\">Ample research<\/a> has <a href=\"https:\/\/www.acog.org\/clinical\/clinical-guidance\/practice-bulletin\/articles\/2020\/10\/medication-abortion-up-to-70-days-of-gestation\" target=\"_blank\">shown<\/a> that <a href=\"https:\/\/www.cnn.com\/health\/abortion-pill-safety-dg\/index.html\" target=\"_blank\">mifepristone<\/a> and misoprostol, the two pills that induce an abortion, <a href=\"https:\/\/www.americanprogress.org\/article\/the-fdas-decisions-on-mifepristone-have-advanced-the-safety-of-medication-abortion\/\" target=\"_blank\">are safe and effective<\/a>.)<\/p>\n<p>Carpenter is also facing criminal charges in Louisiana for allegedly <a href=\"https:\/\/www.msnbc.com\/top-stories\/latest\/louisiana-abortion-pill-new-york-criminal-charges-rcna190290\" target=\"_blank\">prescribing abortion pills to a patient<\/a> in the state. New York Gov. Kathy Hochul last month rejected Louisiana&rsquo;s request to extradite Carpenter, setting up another potential showdown over New York&rsquo;s shield laws.<\/p>\n<p>New York is one of <a href=\"https:\/\/law.ucla.edu\/academics\/centers\/center-reproductive-health-law-and-policy\/shield-laws-reproductive-and-gender-affirming-health-care-state-law-guide\" target=\"_blank\">more than a dozen states <\/a>with legislation to protect patients, health care providers or others who help people access reproductive care in states where it is outlawed. Texas&rsquo; case against Carpenter &mdash; as well as<strong> <\/strong>Louisiana&rsquo;s &mdash; are likely to be scrutinized by federal courts and <a href=\"https:\/\/www.msnbc.com\/opinion\/msnbc-opinion\/texas-ken-paxton-new-york-abortion-pill-lawsuit-rcna184410\" target=\"_blank\">eventually reach the Supreme Court<\/a>.<\/p>\n<p>Carpenter has not made any public statements about either case. The Abortion Coalition for Telemedicine, a group co-founded by Carpenter that supports telehealth abortion providers across the country, commended Bruck&rsquo;s actions in a statement to BLN:<\/p>\n<section>\n<blockquote>\n<p>Shield laws are a critical safeguard that protect both providers and patients nationwide.
