{"id":5931,"date":"2025-02-09T12:16:04","date_gmt":"2025-02-09T12:16:04","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/as-trump-steamrolls-washington-courts-flex-their-power-to-slow-him-down\/"},"modified":"2025-02-09T12:16:04","modified_gmt":"2025-02-09T12:16:04","slug":"as-trump-steamrolls-washington-courts-flex-their-power-to-slow-him-down","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/as-trump-steamrolls-washington-courts-flex-their-power-to-slow-him-down\/","title":{"rendered":"As Trump steamrolls Washington, courts flex their power to slow him down"},"content":{"rendered":"<div>\n<p>President Donald Trump\u2019s \u201cshock and awe\u201d assertion of executive power has hit a wall in the courtroom \u2014 at least for now.<\/p>\n<p>At least nine federal judges \u2014 from Washington, D.C., to Washington state \u2014 have halted aspects of Trump\u2019s early-term blitz, from his effort to rewrite the Constitution\u2019s birthright citizenship guarantee to his sweeping effort to freeze federal spending to his plans to break and remake the federal workforce.<\/p>\n<p>That trend reached a crescendo Friday when U.S. District Judge Carl Nichols \u2014 a Trump appointee \u2014 <a href=\"https:\/\/www.politico.com\/news\/2025\/02\/07\/judge-blocks-trump-administration-plan-usaid-workers-leave-00203205\" target=\"_blank\">blocked a plan<\/a> by Trump and Elon Musk to put 2,200 USAID employees on leave, part of a rapid-fire effort to dismantle the foreign aid agency. Hours later, a federal judge in New York <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.636609\/gov.uscourts.nysd.636609.6.0.pdf\" target=\"_blank\">blocked Musk and his allies<\/a>from accessing sensitive Treasury records, citing a risk of improper disclosure or hacking. The ruling by U.S. District Judge Paul Engelmayer, an Obama appointee, was the most sweeping of its kind so far.<\/p>\n<p>All the rulings so far are temporary: They prevent the policies from taking effect while the courts consider the legal challenges more fully. And looming over them all is the Supreme Court, which is almost certain to have the final say on Trump\u2019s extraordinary assertions of executive power. Trump\u2019s legal strategy revolves around finding a sympathetic audience there: The high court has a six-justice conservative supermajority, including three of Trump\u2019s own appointees.<\/p>\n<p>But even if the wins for Trump\u2019s adversaries are short-lived, they\u2019re accomplishing one thing: slowing down Trump\u2019s effort to project his administration as an unstoppable, invincible force able to steamroll any impediments to his assertion of power.<\/p>\n<p>As dozens of lawsuits challenging Trump\u2019s early policies are rushing through several strategically chosen federal district courts around the country \u2014 and as a Republican-controlled Congress has shown little interest in clashing with the leader of their party \u2014 these courts have emerged as the only institutions with the power and the will to check Trump\u2019s onslaught.<\/p>\n<p>In some cases, judges are voicing distress and even visceral fury as they stand in Trump\u2019s way.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/bluelightnews.com\/wp-content\/uploads\/2025\/02\/aptopix-trump-inauguration-49368.jpg\" alt=\"Trump points at Chief Justice John Roberts at his inauguration ceremony. Trump is hopeful that the Supreme Court will side with him on matters of executive power. \"><\/p>\n<p>&#8220;It has become ever more apparent that to our president, the rule of law is but an impediment to his policy goals,\u201d said U.S. District Judge John Coughenour, a Seattle-based appointee of Ronald Reagan, <a href=\"https:\/\/www.politico.com\/news\/2025\/02\/06\/judge-slams-trump-birthright-citizenship-00202928\" target=\"_blank\">as he blocked Trump\u2019s birthright citizenship policy<\/a>. \u201cThe rule of law is, according to him, something to navigate around or simply ignore.\u201d<\/p>\n<p>Though Coughenour spoke most forcefully, he hasn\u2019t been alone. He, Nichols, Engelmayer and at least six other federal judges appointed by presidents of both parties have disrupted major portions of Trump\u2019s first-month agenda.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/03\/trump-federal-funding-freeze-011315\">U.S. District Judge Loren AliKhan<\/a>, a Joe Biden appointee in Washington, D.C., and <a href=\"https:\/\/www.politico.com\/news\/2025\/01\/31\/judge-block-trump-spending-freeze-00201899\">U.S. District Judge John McConnell<\/a>, a Barack Obama appointee in Rhode Island, blocked Trump\u2019s effort to implement a blanket freeze on billions of dollars in federal spending.\u00a0<\/li>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/06\/trump-feds-exit-plan-block-00202883\">U.S. District Judge George O\u2019 Toole<\/a>, a Bill Clinton appointee in Massachusetts, halted a government-wide program encouraging thousands of federal workers to resign.<\/li>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/05\/elon-musk-lawsuit-treasury-records-00202736\">U.S. District Judge Colleen Kollar-Kotelly<\/a>, a Clinton appointee in Washington, D.C., coaxed an agreement to block Treasury officials from sharing details of the government\u2019s massive payment system \u2014 accessed by allies of Musk \u2014 with anyone outside the department.<\/li>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/04\/judge-blocks-trumps-executive-order-on-transgender-prisoners-00202521\">U.S. District Judge Royce Lamberth<\/a>, a Reagan appointee in Washington, D.C., blocked the implementation of Trump\u2019s order to transfer transgender women inmates to men\u2019s prisons.<\/li>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/05\/birthright-citizenship-trump-executive-order-012147\">U.S. District Judge Deborah Boardman<\/a>, a Maryland-based Biden appointee, joined Coughenour in blocking Trump\u2019s birthright citizenship order.\u00a0<\/li>\n<li><a href=\"https:\/\/www.politico.com\/news\/2025\/02\/07\/trump-administration-fbi-agents-jan-6-014223\">U.S. District Judge Jia Cobb<\/a>, a Biden appointee in Washington, D.C., barred the Trump administration from disclosing the names of FBI agents who worked on Jan. 6 cases \u2014 without at least a two-day warning for the agents to come back to court.<\/li>\n<\/ul>\n<p>Coughenour\u2019s stunning assessment of a sitting president was also a stark contrast to the GOP-led Congress\u2019 gentle compliance with Trump\u2019s efforts to dramatically expand the powers of his office. Moves that have rattled the federal workforce and raised fears of a sweeping retribution campaign against officials deemed disloyal to Trump \u2014 particularly in the FBI and Justice Department \u2014 have been largely met with shrugs from Republicans on Capitol Hill.<br \/>Those congressional Republicans appear content to let Trump \u2014 backed by Musk, his <a href=\"https:\/\/x.com\/elonmusk\/status\/1886625632836104529\" target=\"_blank\">roving \u201cwood chipper\u201d<\/a> \u2014 <a href=\"https:\/\/www.politico.com\/news\/2025\/02\/03\/doge-treasury-usaid-donald-trump-011538\" target=\"_blank\">steamroll the federal bureaucracy<\/a>, <a href=\"https:\/\/www.politico.com\/news\/2025\/01\/25\/donald-trump-inspectors-general-firing-00200611\" target=\"_blank\">purge independent watchdogs<\/a> and <a href=\"https:\/\/www.politico.com\/news\/2025\/02\/04\/trump-administration-usaid-staff-on-leave-00202411\" target=\"_blank\">dismantle federal agencies<\/a> without much pushback. Democrats, mired in the minority for the first time since 2018, have <a href=\"https:\/\/www.politico.com\/news\/2025\/02\/05\/senate-democrats-trump-musk-resistance-012557\" target=\"_blank\">proven largely toothless<\/a> in response, leaving their base frustrated.<\/p>\n<p>That has left the courts, which have been flooded by lawsuits from unions, nonprofits, state governments and other organizations affected by the White House\u2019s torrent of policy moves, as the lone check on Trump.<\/p>\n<p>It\u2019s possible that all of these early decisions will be short-lived. Trump is hopeful that the Supreme Court he helped tip sharply to the right will side with him on matters of executive power. In one landmark case, the court has already done just that: Last year, the court <a href=\"https:\/\/www.politico.com\/news\/2024\/07\/01\/supreme-court-trump-immunity-opinion-00166014\" target=\"_blank\">announced a sweeping doctrine of presidential immunity<\/a> that helped Trump stave off federal criminal charges for subverting the 2020 election.<\/p>\n<p>None of the cases his orders have triggered has yet reached the appellate courts, let alone the Supreme Court. But as Trump\u2019s Justice Department begins to file appeals challenging the growing list of injunctions, the cases could begin reaching the justices in the coming weeks.<\/p>\n<p>For now, the initial decisions to slow down the onslaught are having widespread effects, forcing federal agencies to disclose more details about their opaque plans for the workforce, establishing guidelines for the handling of sensitive government data that Musk\u2019s \u201cDepartment of Government Efficiency\u201d has been gobbling up and raising sharp questions about Trump\u2019s effort to impound swaths of government spending authorized by Congress.<\/p>\n<p>The legal counterattack doesn\u2019t appear likely to end anytime soon.
