Lawsuits are <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/fbi-agents-trump-firing-civil-lawsuits-rcna190653\" target=\"_blank\">being filed<\/a> and trial courts are <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-federal-funding-freeze-judge-restraining-order-rcna190482\" target=\"_blank\">weighing in<\/a>with judges already dealing the administration <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/birthright-citizenship-judge-blocked-maryland-trump-rcna190822\" target=\"_blank\">a series of losses<\/a>. But it&rsquo;s early yet in a process that will likely land at <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-nlrb-gwynne-wilcox-firing-rcna190876\" target=\"_blank\">the Supreme Court<\/a> on several fronts.<\/p>\n<p><strong>&ldquo;Disingenuous&rdquo; is how one judge described Trump&rsquo;s <\/strong>attempt to avoid legal scrutiny of his federal spending freeze. <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-federal-funding-freeze-judge-restraining-order-rcna190482\" target=\"_blank\">Halting the effort<\/a> Monday, U.S. District Judge Loren AliKhan wrote that instead of taking &ldquo;a measured approach to identify purportedly wasteful spending,&rdquo; the government &ldquo;cut the fuel supply to a vast, complicated, nationwide machine &mdash; seemingly without any consideration for the consequences of that decision.&rdquo; The Biden appointee&rsquo;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276842\/gov.uscourts.dcd.276842.30.0_3.pdf\" target=\"_blank\">temporary restraining order<\/a> in the District of Columbia followed a Rhode Island judge&rsquo;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.rid.58912\/gov.uscourts.rid.58912.50.0_7.pdf\" target=\"_blank\">order<\/a> likewise blocking Trump&rsquo;s bid to &ldquo;pause&rdquo; trillions of dollars of congressionally approved funds.<\/p>\n<p><strong>&ldquo;Untenable&rdquo; is how another judge described Trump&rsquo;s<\/strong> argument against <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/birthright-citizenship-trump-supreme-court-james-ho-rcna184938\" target=\"_blank\">birthright citizenship<\/a>. Reminding the government that it&rsquo;s an &ldquo;unequivocal Constitutional right,&rdquo; U.S. District Judge John Coughenour in Seattle granted a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wawd.343943\/gov.uscourts.wawd.343943.114.0_1.pdf\" target=\"_blank\">preliminary injunction<\/a> against the president&rsquo;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\">executive order<\/a> seeking to upend that right. The Reagan appointee&rsquo;s rebuke echoed a Biden appointee&rsquo;s ruling affirming the long-standing right, with the latter judge in Maryland <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.574698\/gov.uscourts.mdd.574698.65.0_1.pdf\" target=\"_blank\">writing that<\/a> Trump&rsquo;s order &ldquo;interprets the Citizenship Clause of the Fourteenth Amendment in a manner that the Supreme Court has resoundingly rejected and no court in the country has ever endorsed.&rdquo;<\/p>\n<p><strong>We&rsquo;ll see what today&rsquo;s Supreme Court says<\/strong> about that issue and others poised to reach <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-ruling-supreme-court-overview-rcna159807\" target=\"_blank\">the justices<\/a>.<\/p>\n<p><strong>Another brewing Supreme Court test <\/strong>stems from the president removing a National Labor Relations Board member whose congressionally approved term isn&rsquo;t up until 2028. <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-nlrb-gwynne-wilcox-firing-rcna190876\" target=\"_blank\">Trump&rsquo;s action<\/a> against Gwynne Wilcox violates a <a href=\"https:\/\/www.law.cornell.edu\/wex\/national_labor_relations_act_nlra\" target=\"_blank\">federal law<\/a> that says presidents can only remove members for cause and with notice and a hearing, none of which Wilcox received, she said in her <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277129\/gov.uscourts.dcd.277129.1.0_1.pdf\" target=\"_blank\">complaint<\/a> filed this week. The firing likewise contradicts a 1935 Supreme Court case called <a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" target=\"_blank\">Humphrey&rsquo;s Executor<\/a>. That precedent was called out for targeting by <a href=\"https:\/\/www.americanprogress.org\/article\/project-2025-would-destroy-the-u-s-system-of-checks-and-balances-and-create-an-imperial-presidency\/\" target=\"_blank\">Project 2025<\/a>the conservative blueprint that Trump <a href=\"https:\/\/www.npr.org\/2024\/08\/22\/g-s1-19202\/trump-project-2025-border-immigration\" target=\"_blank\">tried to distance himself from<\/a> during his campaign but has embraced in office.<\/p>\n<p><strong>And that&rsquo;s just some of the latest legal action<\/strong> prompted by the first days of Trump&rsquo;s second term. Another development was <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/fbi-agents-trump-firing-civil-lawsuits-rcna190653\" target=\"_blank\">lawsuits from FBI agents<\/a> who worked on Jan. 6 cases, who said they feared retaliation from the government they served. In response to the litigation, the Trump administration <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277085\/gov.uscourts.dcd.277085.12.0.pdf\" target=\"_blank\">agreed<\/a> not to release their names, providing some comfort to agents concerned for their safety because of the actions of the president and his supporters.<\/p>\n<p><strong>Meanwhile, Pam Bondi was confirmed as Trump&rsquo;s attorney general <\/strong><a href=\"https:\/\/www.npr.org\/2025\/02\/04\/nx-s1-5287011\/pam-bondi-attorney-general-confirmation\" target=\"_blank\">54-46<\/a>. The president&rsquo;s <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/pam-bondi-trump-attorney-general-deadline-newsletter-rcna181331\" target=\"_blank\">impeachment lawyer<\/a> from his first term began by <a href=\"https:\/\/s3.documentcloud.org\/documents\/25514009\/zealous-advocacy.pdf\" target=\"_blank\">telling Justice Department staff<\/a> that, contrary to tradition, DOJ lawyers are &ldquo;his&rdquo; (i.e. Trump&rsquo;s) lawyers. As The Washington Post <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/02\/05\/pam-bondi-attorney-general\/\" target=\"_blank\">explained<\/a>Bondi &ldquo;spent her first day on the job Wednesday redirecting the [DOJ&rsquo;s] significant law enforcement authority toward addressing [Trump&rsquo;s] grievances with the agency.&rdquo;<\/p>\n<p><strong>Elsewhere in Trump&rsquo;s DOJ, <\/strong>his interim U.S. attorney in the District of Columbia has made his allegiance clear to Trump and his ally <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/musks-doge-operation-keeps-gaining-new-access-sensitive-information-rcna191180\" target=\"_blank\">Elon Musk<\/a>whose actions with his Department of Government Efficiency team have sparked its own <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/trump-administration-agrees-restrict-doge-access-treasury-department-p-rcna190898\" target=\"_blank\">emerging legal docket<\/a>. That temporary top prosecutor, former Jan. 6 defense lawyer <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/ed-martin-jan-6-lawyer-padilla-us-attorney-rcna191041\" target=\"_blank\">And Martin<\/a>has been penning dramatic, supportive letters to Musk directly &mdash; <a href=\"https:\/\/x.com\/EagleEdMartin\/status\/1887901087983689761\/photo\/1\" target=\"_blank\">and, for unexplained reasons, exclusively<\/a> &mdash; on the billionaire&rsquo;s social media platform. While Martin hasn&rsquo;t specified who he&rsquo;s going after <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/ed-martin-dc-attorney-elon-musk-doge-rcna190792\" target=\"_blank\">on Musk and DOGE&rsquo;s behalf<\/a> or in violation of which laws, his public statements do well to capture the new administration&rsquo;s approach to <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/ed-martin-dc-attorney-elon-musk-doge-rcna190792\" target=\"_blank\">&ldquo;law and order.&rdquo;<\/a><\/p>\n<p><strong>And speaking of who gets government protection these days<\/strong>Trump&#8217;s Doj&#8221;https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-477\/342223\/20250207133625781_Letter23-477.pdf&#8221; target=&#8221;_blank&#8221;&gt;just told the Supreme Court that it no longer thinks Tennessee&rsquo;s ban on gender-affirming care for minors violates the Constitution. Whether it does is at issue in the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-transgender-care-skrmetti-rcna182505\" target=\"_blank\">pending case<\/a> of United States v. Skrmetti &mdash; &ldquo;United States&rdquo; leading that case caption because the government during the Biden administration had appealed the issue to the justices. The case was <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/neil-gorsuch-supreme-court-transgender-skrmetti-rcna182867\" target=\"_blank\">argued last year<\/a> and is awaiting a decision from the court (likely to come by July). The DOJ didn&rsquo;t ask the justices to dismiss the appeal, but it wanted the court to know that &ldquo;the government&rsquo;s previously stated views no longer represent the United States&rsquo; position.&rdquo; As the brief rundown in this week&rsquo;s newsletter shows, that understated line is true of much government activity these days.<\/p>\n<p><strong>Have any questions or comments for me?
