In firing Wilcox, the Trump administration flouted a federal statute that said NLRB board members can only be removed \u201cfor neglect of duty or malfeasance in office, but for no other cause.\u201d<\/p>\n<p>In its Jan. 27 <a href=\"https:\/\/subscriber.politicopro.com\/f\/?id=00000194-c876-df22-a5df-dafef80d0000\" target=\"_blank\">letter to Wilcox and general counsel Jennifer Abruzzo<\/a>, a fellow Democratic appointee who was simultaneously removed, the White House stated that part of the National Labor Relations Act \u201cdoes not operate as a restriction on [the president&#8217;s] ability to remove Board members.\u201d<\/p>\n<p>Though Abruzzo&#8217;s firing was widely expected, <a href=\"https:\/\/subscriber.politicopro.com\/article\/2025\/01\/trump-fires-bidens-general-counsel-at-nlrb-00199319\" target=\"_blank\">Wilcox&#8217;s unprecedented removal<\/a> has left the NLRB without the quorum necessary to rule on cases, grinding much of the agency\u2019s most consequential work to a standstill. <\/p>\n<p>Wilcox is asking the court to declare that she remains a \u201crightful member of the Board and that the President lacks authority to remove her\u201d outside of the process outlined by the NLRA.<\/p>\n<p>The White House did not immediately return a request for comment.
