{"id":5609,"date":"2025-01-31T22:25:28","date_gmt":"2025-01-31T22:25:28","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/ask-jordan-will-trump-be-back-in-court-after-he-leaves-office\/"},"modified":"2025-01-31T22:25:28","modified_gmt":"2025-01-31T22:25:28","slug":"ask-jordan-will-trump-be-back-in-court-after-he-leaves-office","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/ask-jordan-will-trump-be-back-in-court-after-he-leaves-office\/","title":{"rendered":"Ask Jordan: Will Trump be back in court after he leaves office?"},"content":{"rendered":"<div>\n<p><strong>&ldquo;To what is Trump looking forward after his four years are up?&nbsp;He will&nbsp;be in his 80s then.&rdquo;<\/strong><\/p>\n<p>&mdash; Stephen Metelits, Chapel Hill, N.C.<\/p>\n<p>Hi Stephen,<\/p>\n<p><a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-fifth-amendment-civil-rcna68588\" target=\"_blank\">Litigation<\/a> could still be a significant feature of Trump&rsquo;s life <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/new-gop-bill-let-trump-not-obama-run-third-term-rcna189099\" target=\"_blank\">after the presidency<\/a>.<\/p>\n<p>In terms of criminal exposure, his 2024 election win halved his caseload <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/jack-smith-report-trump-merrick-garland-legal-war-rcna187946\" target=\"_blank\">because of Justice Department policy<\/a> against prosecuting sitting presidents. His two state cases, however, are still around in different ways that could further develop in the coming months and years. As I&rsquo;ll explain, Trump could have at least one criminal trial waiting for him when he leaves the White House.<\/p>\n<p>In New York, the president <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-hush-money-appeal-new-lawyers-rcna189857\" target=\"_blank\">hired new lawyers<\/a> to appeal his hush money conviction. That could take a while to move through the state courts and potentially the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-trump-new-york-hush-money-sentencing-rcna186952\" target=\"_blank\">U.S. Supreme Court<\/a>. But let&rsquo;s assume, for purposes of this discussion, that he gets his conviction overturned. That wouldn&rsquo;t make the case disappear. It would just get him a new trial. <\/p>\n<p>If he&#8217;s convicted again, he won&#8217;t have that protection from normal sentencing options.<\/p>\n<p>Suppose he wins relief while he&#8217;s in office. In that case, a trial would have to wait until he leaves office (and even his supporters <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/new-gop-bill-let-trump-not-obama-run-third-term-rcna189099\" target=\"_blank\">have conceded<\/a> that an unlikely constitutional amendment <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-jokes-running-third-term-speech-house-republicans-rcna189530\" target=\"_blank\">is needed<\/a> to run for a third term). But if New York prosecutors want to retry him in that hypothetical scenario, then that&rsquo;s a reality he could face post-presidency.&nbsp;And remember that Judge Juan Merchan sentenced him to the penalty-free <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/unconditional-discharge-trump-sentencing-hush-money-rcna187044\" target=\"_blank\">unconditional discharge<\/a> because of his then-impending White House return. If he&rsquo;s convicted again in a post-presidency trial, he won&#8217;t have that protection from normal sentencing options such as incarceration or probation.<\/p>\n<p>And while Trump&rsquo;s New York case could end in several ways, his other state case &mdash; in Georgia &mdash; is even more complicated. Not only did that one not go to trial before the election, it didn&#8217;t even come close. It was derailed by a pretrial defense appeal that sought to kick Fulton County District Attorney Fani Willis off the case. That effort <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/georgia-court-disqualifies-fani-willis-trump-election-rcna184839\" target=\"_blank\">succeeded last year<\/a> at the intermediate state appellate level, and Willis is pressing Georgia&rsquo;s top court <a href=\"https:\/\/www.ajc.com\/politics\/fulton-da-asks-georgias-top-court-to-reinstate-her-on-trump-election-interference-case\/LKCOSJAO25BIHAMPGKMMU3OWKM\/\" target=\"_blank\">to intervene<\/a>.<\/p>\n<p>If she fails and her office remains disqualified from prosecuting the state election interference case, then there&rsquo;s a big question of when <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/burt-jones-georgia-trump-case-fani-willis-rcna171100\" target=\"_blank\">or even whether<\/a> another prosecutor would take on the complex matter featuring high-profile political figures. If she&rsquo;s reinstated, the case can move forward against the remaining co-defendants on the indictment, with Trump being just one of 19 people <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-indictment-document-fulton-county-georgia-full-text-pdf-rcna79584\" target=\"_blank\">charged<\/a> (several have pleaded guilty, but <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-georgia-election-fani-willis-plea-deals-rcna127164\" target=\"_blank\">many remain<\/a>). Like in the New York case, criminal proceedings wouldn&rsquo;t move forward against Trump himself while he&rsquo;s in office. But as in New York, the case could be waiting for him when he leaves.<\/p>\n<p>So, while the president&rsquo;s criminal exposure is not as severe as <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-criminal-cases-election-ask-jordan-rcna177256\" target=\"_blank\">before he won<\/a> the 2024 election, fighting to stay out of prison could also become a top priority after he leaves the White House.<\/p>\n<p><strong>Have any questions or comments for me?
