{"id":4590,"date":"2025-01-07T23:03:52","date_gmt":"2025-01-07T23:03:52","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/durbin-calls-on-doj-to-withdraw-certain-legal-opinions-on-presidential-war-powers\/"},"modified":"2025-01-07T23:03:52","modified_gmt":"2025-01-07T23:03:52","slug":"durbin-calls-on-doj-to-withdraw-certain-legal-opinions-on-presidential-war-powers","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/durbin-calls-on-doj-to-withdraw-certain-legal-opinions-on-presidential-war-powers\/","title":{"rendered":"Durbin calls on DOJ to withdraw certain legal opinions on presidential war powers"},"content":{"rendered":"<div>\n<p>Former Senate Judiciary Chair Dick Durbin is<a href=\"https:\/\/www.politico.com\/f\/?id=00000194-42e4-d454-afdc-4afff70d0000\" target=\"_blank\">\u00a0asking the Biden administration to withdraw or release<\/a> some 20 legal opinions regarding presidential war powers after Donald Trump indicated Tuesday that he was open to using military force to take Greenland or the Panama Canal.<\/p>\n<p>\u201cCongress and the executive branch may have differing views in some respects as to the separation of powers between them,\u201d Durbin wrote in his letter to Attorney General Merrick Garland. \u201cHowever, these opinions are concerning outliers even by the standards of the executive branch\u2019s own legal doctrine.\u201d<\/p>\n<p>Durbin\u2019s request spans a host of legal opinions, ranging from 1953 all the way to \u201ca 2020 memorandum articulating one of the government\u2019s justifications for killing Iranian General Qassem Soleimani.\u201d<\/p>\n<p>In addition, Durbin asked the department to release records related to \u201cthe domestic use of the U.S. military.\u201d <\/p>\n<p>\u201cThe American people have a right to know how the Executive Branch interprets the President\u2019s constitutional and statutory authority to use the military domestically,\u201d Durbin wrote.<\/p>\n<p>Trump was asked at a press conference Tuesday if he would rule out economic or military coercion to gain control of Greenland and the Panama Canal. He replied: \u201cI\u2019m not gonna commit to that.
