The Supreme Court held a <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-transgender-care-skrmetti-rcna182505\" target=\"_blank\">major hearing<\/a> on transgender rights that highlighted the court&rsquo;s partisan split, while Democrats kept confirming judges to the lower federal courts before Republicans take over next month. The impending transfer of power also puts a spotlight on clemency, with outgoing President Joe Biden <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/judge-mark-scarsi-hunter-biden-pardon-trump-rcna182781\" target=\"_blank\">pardoning his son<\/a> Hunter and his aides <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/possible-preemptive-pardons-biden-sparks-democratic-debate-rcna182998\" target=\"_blank\">reportedly considering<\/a> pushing the same benefit for potential targets of the incoming administration. And in the dwindling saga of the president-elect&rsquo;s criminal prosecutions, his two federal cases are gone as we move closer to learning the fate of his two <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-georgia-case-fani-willis-toss-rcna182902\" target=\"_blank\">state cases<\/a>.<\/p>\n<p class><strong>Transgender rights<\/strong> were at issue during Wednesday&rsquo;s hearing in United States v. Skrmetti. <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/united-states-v-skrmetti\/\" target=\"_blank\">The question<\/a> there is whether a Tennessee law banning gender-affirming care for minors violates the Constitution&rsquo;s equal protection clause. The court&rsquo;s GOP-appointed majority <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-tackles-state-bans-treatments-transgender-youth-rcna182517\" target=\"_blank\">seems to think not<\/a>though Justice Neil Gorsuch was <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/neil-gorsuch-supreme-court-transgender-skrmetti-rcna182867\" target=\"_blank\">notably silent<\/a>. The Trump appointee wrote a <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/17-1618_hfci.pdf\" target=\"_blank\">2020 ruling<\/a> backing transgender workplace protections, and his vote could be important in Skrmetti. The court&rsquo;s eventual decision, expected by July, could affect similar laws <a href=\"https:\/\/www.kff.org\/other\/dashboard\/gender-affirming-care-policy-tracker\/\" target=\"_blank\">across the country<\/a> and LGBTQ+ rights more broadly.<\/p>\n<p class><strong>Justice Ketanji Brown Jackson<\/strong> drew a parallel to <a href=\"https:\/\/www.oyez.org\/cases\/1966\/395\" target=\"_blank\">Loving v. Virginia<\/a>the landmark 1967 Supreme Court case that struck down the state&rsquo;s interracial marriage ban on equal protection grounds. Tennessee <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-477\/327730\/20241008130915048_23-477RespondentsBrief.pdf\" target=\"_blank\">argues that<\/a> its law doesn&rsquo;t discriminate based on sex, which led the Biden appointee <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2024\/23-477_c07d.pdf\" target=\"_blank\">to wonder<\/a> &ldquo;whether Virginia could have gotten away with what they did here by just making a classification argument the way that Tennessee is in this case.&rdquo;<\/p>\n<p class><strong>That Jackson&rsquo;s concern stood out<\/strong> illustrates the 6-3 split on the court between appointees of Republican and Democratic presidents. While Biden will get only one Supreme Court appointment in his term, the rift on the nation&rsquo;s top court places even greater significance on Democrats&rsquo; push to confirm judges to the federal trial and appeals courts. This week brought the total number of confirmations during the current administration to 229, as Democrats <a href=\"https:\/\/www.yahoo.com\/news\/u-senate-votes-narrowly-confirm-040300596.html\" target=\"_blank\">close in<\/a> on the 234 judges in <a href=\"https:\/\/msnbc.com\/donald-trump\" target=\"_blank\">Donald Trump&rsquo;s<\/a> first term. The coming days and weeks will determine whether they break that number before Republicans take over the White House and Senate next month.<\/p>\n<p class><strong>More pardons could come, too<\/strong>after Biden granted clemency for Hunter on Sunday before he could be sentenced on gun and tax charges. The president previously said he wouldn&rsquo;t pardon his son, <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/12\/01\/statement-from-president-joe-biden-11\/\" target=\"_blank\">but he argued<\/a> Sunday that &ldquo;raw politics has infected this process and it led to a miscarriage of justice.&rdquo; Whatever one&rsquo;s views on the matter, it shows the president is capable of granting clemency when he sees an injustice. The bigger question now is whether he&rsquo;ll do so for <a href=\"https:\/\/www.thenation.com\/article\/politics\/hunter-biden-pardon-democrats\/\" target=\"_blank\">more people he isn&rsquo;t related to<\/a>including those for whom he previously signaled support &mdash; such as death row prisoners <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/biden-trump-commute-executions-eliminate-death-penalty-rcna179583\" target=\"_blank\">he said<\/a> should serve life sentences instead and people convicted of <a href=\"https:\/\/www.marijuanamoment.net\/as-biden-pardons-his-son-hunter-hes-running-out-of-time-to-fulfill-his-marijuana-clemency-promise-op-ed\/\" target=\"_blank\">marijuana-related crimes<\/a>.<\/p>\n<p class><strong>Meanwhile, Trump is trying to toss<\/strong> his New York and Georgia state cases before he takes office. The president-elect&rsquo;s New York defense lawyers (whom he <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-justice-department-picks-gaetz-deadline-newsletter-rcna180386\" target=\"_blank\">named to top DOJ posts<\/a> in his administration) want Judge Juan Merchan <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-new-york-hush-money-motion-hunter-biden-jack-smith-rcna182704\" target=\"_blank\">to dismiss the hush money case<\/a> due to their client&rsquo;s political victory. Manhattan District Attorney Alvin Bragg gets to respond in a filing due Monday, after which Merchan will decide whether the case moves toward sentencing in the only prosecution of Trump that went to trial.<\/p>\n<p class><strong>In Georgia, Trump&rsquo;s lawyers launched<\/strong> a <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-georgia-case-fani-willis-toss-rcna182902\" target=\"_blank\">similar effort this week<\/a> to get out of the state election interference case there. With his two federal cases gone, we&rsquo;ll soon learn what happens in the murkier question of his state cases, which presidents can&rsquo;t pardon away or get their attorneys general to dismiss like federal ones.<\/p>\n<p class><strong>The Supreme Court added to its docket<\/strong> Friday with cases to be argued later this term, over <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23-1345.html\" target=\"_blank\">federal habeas corpus<\/a> litigation and an appeal about whether terror victims <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-agrees-weigh-terrorist-victims-bid-sue-palestinian-entit-rcna182716\" target=\"_blank\">can sue<\/a> the Palestine Liberation Organization and Palestinian Authority in U.S. courts.
