Max Miller is threatening legal action to block a television ad created by his Democratic challenger Brian Poindexter that includes allegations of domestic abuse.<\/p>\n<p>A lawyer for Miller is demanding Cleveland-area television station WKYC stop publishing \u201cfalse, malicious, and defamatory statements\u201d in a <a href=\"https:\/\/www.politico.com\/f\/?id=000001a0-c068-d276-aff6-e16f61530000\" target=\"_blank\"><u>cease-and-desist letter<\/u><\/a> sent Thursday and shared with Blue Light News by the Poindexter campaign. Miller has previously denied the abuse accusations.<\/p>\n<p>The ad and ensuing legal threat mark a major escalation in the race between Miller and Poindexter. For much of his campaign, Poindexter avoided directly attacking Miller\u2019s legal troubles, highlighting instead his working-class background and affordability.<\/p>\n<p>With the ad, the two candidates are litigating the accusations in the public eye and placing Miller\u2019s family drama at the heart of the race.<\/p>\n<p>Miller&#8217;s lawyer Alejandro Brito \u2014 who has repeatedly represented President Donald Trump \u2014 said WKYC\u2019s failure to comply with the cease and desist \u201cwill leave Congressman Miller with no choice but to pursue any and all legal rights and remedies available to recover damages for the overwhelming financial and reputational harm that Defendant will cause him to suffer.\u201d<\/p>\n<p>Miller is facing allegations of <a href=\"https:\/\/www.politico.com\/news\/2026\/08\/01\/max-miller-abuse-divorce-gop-01021028\" target=\"_blank\"><u>abuse from his ex-wife<\/u><\/a>, Emily Moreno, the daughter of Ohio Sen. Bernie Moreno. They include accusations he poured hot water on Emily Moreno, held a gun to her head and broke his two-year-old daughter\u2019s collarbone.<\/p>\n<p>The 30-second <a href=\"https:\/\/x.com\/bpforcongress\/status\/2099815631830786560?s=20\" target=\"_blank\"><u>Poindexter ad<\/u><\/a> depicts a local sheriff listing some of those allegations, and saying, \u201c34 years in law enforcement tells me: Max Miller does not belong in power.\u201d<\/p>\n<p>A spokesperson for Miller declined to comment. WKYC also did not return a request for comment.<\/p>\n<p>In a <a href=\"https:\/\/youtube.com\/shorts\/YZxbRVirHb4?feature=share\" target=\"_blank\"><u>video response<\/u><\/a> shared with Blue Light News \u2014 which the campaign will use to fundraise \u2014 Poindexter rips up the letter.<\/p>\n<p>\u201cHe\u2019s threatening to sue because he doesn\u2019t want people to hear the facts. Here are the facts,\u201d Poindexter said. \u201cMax Miller has been accused of abuse by three women\u2026 Max Miller used his money and fancy lawyers to get himself out of his trouble his whole life. Not this time.\u201d<\/p>\n<p>Miller is not on the House Republican campaign arm\u2019s <a href=\"https:\/\/nrcc.org\/wp-content\/uploads\/2026\/04\/NRCC-Patriots-1.pdf\" target=\"_blank\">\u201cPatriots\u201d list<\/a> which features the most vulnerable members who typically get the bulk of its spending. However, recent <a href=\"https:\/\/www.nytimes.com\/interactive\/polls\/ohio-us-house-7-polls-2026.html\" target=\"_blank\"><u>polling<\/u><\/a> suggests a tight race between Miller and Poindexter, and national campaign brass has taken notice.<\/p>\n<p>The Congressional Leadership Fund, a top Republican super PAC, placed a staggering $4.85 million ad buy for Miller to air Sept. 30 to Nov. 3. The NRCC also <a href=\"https:\/\/www.politico.com\/live-updates\/2026\/09\/03\/congress\/max-miller-nrcc-ad-buy-01064055\" target=\"_blank\"><u>dropped<\/u><\/a> $450,000 on a three week ad-buy supporting Miller that started Sept. 7.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Rep.
