Will Trump follow suit?"},"content":{"rendered":"<div>\n<p class>The morning after his decisive victory, <a href=\"https:\/\/www.msnbc.com\/opinion\/msnbc-opinion\/donald-trump-wins-kamala-harris-loses-fight-continues-rcna178544\" target=\"_blank\" rel=\"noopener\">President-elect Donald Trump<\/a> enjoyed a quiet day at Mar-a-Lago, occasionally talking with world leaders and \u201cthinking about the future,\u201d <a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/live-blog\/trump-win-election-president-2024-harris-live-updates-rcna178996\/rcrd64074?canonicalCard=true\" target=\"_blank\" rel=\"noopener\">NBC News reported<\/a>, citing a senior campaign official.<\/p>\n<p class>That official also told NBC that, in the wake of his win, Trump\u2019s \u201cbitterness\u201d was gone, stating there\u2019s been \u201cno talk of\u201d <a href=\"https:\/\/www.msnbc.com\/top-stories\/latest\/jack-smith-chutkan-pause-election-interference-trump-rcna179337?icid=latestpost_bot\" target=\"_blank\" rel=\"noopener\">special counsel Jack Smith<\/a> or <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-fraud-trial-appeal-rcna172946\" target=\"_blank\" rel=\"noopener\">New York Attorney General Letitia James<\/a>, two of the prosecutors who have vexed Trump the most through their respective criminal and<em> <\/em>civil cases against him.<\/p>\n<p class>Given Trump\u2019s history of deriding \u2014 and threatening \u2014 his perceived enemies, the official\u2019s assessment warrants a healthy amount of skepticism.<em> <\/em>But even if Trump\u2019s allegedly lighter mood lasts, it\u2019s <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/jim-jordan-advances-investigation-jack-smiths-investigation-rcna179348\" target=\"_blank\" rel=\"noopener\">not entirely mirrored by his key allies<\/a>, including those who frequently come up as potential contenders for leadership roles in the next Trump White House or the Justice Department. Indeed, among that group is Mike Davis, a prominent conservative lawyer whose qualifications for leading the DOJ or serving as White House counsel are matched only by his public thirst for revenge.<\/p>\n<h2 class><strong>\u2018We want him in a very high capacity\u2019<\/strong><\/h2>\n<p class>There is no question that Davis has <a href=\"https:\/\/politicalscience.uiowa.edu\/people\/michael-davis\" target=\"_blank\" rel=\"noopener\">the resume<\/a> to compete for those jobs<strong>, <\/strong>with experience that includes serving as the lead nominations staffer for then-Senate Judiciary Chairman Chuck Grassley, during which he helped shepherd Supreme Court Justices Neil Gorsuch and Brett Kavanaugh through their confirmations. He has also clerked<em> <\/em>for Gorsuch, worked in George W. Bush\u2019s DOJ, and served as an aide to then-House Speaker (and current Trump ally) Newt Gingrich.<\/p>\n<p class>But today, he is better known as <a href=\"https:\/\/www.article3project.org\/about\" target=\"_blank\" rel=\"noopener\">the founder and president of the Article III Project<\/a>, an organization that bills itself as bringing \u201cbrass knuckles to fight leftist lawfare,\u201d and he commands serious attention and respect in the Trump world.\u00a0<\/p>\n<p class>At an October campaign event in Colorado, where Davis primarily resides and practices law, Trump <a href=\"https:\/\/www.washingtonpost.com\/nation\/2024\/10\/19\/mike-davis-trump-judges-maga\/\" target=\"_blank\" rel=\"noopener\">called him out<\/a> by name, exclaiming, \u201cThis guy is tough as hell. &#8230; We want him in a very high capacity.\u201d It\u2019s moments like that that have prompted other outlets, like <a href=\"https:\/\/www.washingtonpost.com\/nation\/2024\/10\/19\/mike-davis-trump-judges-maga\/\" target=\"_blank\" rel=\"noopener\">The Washington Post<\/a>, to note Davis has \u201cpositioned himself to be a key adviser on legal issues and judicial selection.\u201d And perhaps unsurprisingly, the Post also reported Davis had been \u201cprivately floated\u201d by Trump as a potential attorney general.<\/p>\n<figure><picture data-testid=\"picture\"><source media=\"(min-width: 1000px)\" ><source media=\"(min-width: 320px)\" ><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-760w,f_auto,q_auto:best\/rockcms\/2024-11\/241107-mike-davis-2018-ac-525p-bba8df.jpg\" alt=\"Senate Judiciary Committee mike davis\" height=\"1667\" width=\"2500\"><\/picture><figcaption data-testid=\"caption\"><span data-testid=\"caption__container\">Mike Davis, left, then-chief counsel for nominations for the Senate Judiciary Commitee, stands next to Sen. Lindsey Graham, R-S.C., on Sept. 13, 2018.<\/span><span data-testid=\"caption__source\">Tom Williams \/ CQ-Roll Call, Inc via Getty Images file<\/span><\/figcaption><\/figure>\n<p class>Davis, for his part, has stated publicly he prefers <a href=\"https:\/\/www.schaerr-jaffe.com\/attorneys\/mark-r-paoletta\/\" target=\"_blank\" rel=\"noopener\">Mark Paoletta<\/a>, former general counsel for the Office of Management and Budget, <a href=\"https:\/\/x.com\/mrddmia\/status\/1854503736879550935\" target=\"_blank\" rel=\"noopener\">for attorney general<\/a>. Davis also<strong> <\/strong>said he would <a href=\"https:\/\/x.com\/mrddmia\/status\/1854523777729650840\" target=\"_blank\" rel=\"noopener\">rather serve as Trump\u2019s \u201cviceroy\u201d<\/a> than as White House counsel, <a href=\"https:\/\/www.mediamatters.org\/steve-bannon\/trump-insider-mike-davis-im-going-be-trumps-viceroy-dc-because-i-dont-democracy\" target=\"_blank\" rel=\"noopener\">telling Trump adviser Steve Bannon in March<\/a> that he would prefer to be a viceroy of Washington, D.C., \u201cbecause I don\u2019t like democracy.\u201d<\/p>\n<p class>But here\u2019s where things get scary. For a guy who disclaims any desire to fill an official role, he has been remarkably specific about what he thinks should happen next \u2014 and confident that it will. <\/p>\n<p class>For example, on Wednesday morning, when Trump was allegedly ebullient, <a href=\"https:\/\/x.com\/mrddmia\/status\/1854200785975775609\" target=\"_blank\" rel=\"noopener\">Davis tweeted<\/a> a very different \u201ccurrent mood\u201d: \u201cI want to drag their dead political bodies,\u201d presumably referring to Democrats or some subgroup thereof, \u201cthrough the streets, burn them, and throw them off the wall. (Legally, politically, and financially, of course.)\u201d<\/p>\n<p class>And if that were not concerning enough, consider that on Wednesday and Thursday on X, Davis:<\/p>\n<ul>\n<li>Instructed former Rep. <a href=\"https:\/\/x.com\/mrddmia\/status\/1854167845120233514\" target=\"_blank\" rel=\"noopener\">Liz Cheney, R-Wyo., to \u201clawyer up\u201d <\/a>because \u201c[t]he evidence suggests you colluded with a key January 6th witness\u201d \u2014 referring to <a href=\"https:\/\/www.msnbc.com\/morning-joe\/watch\/cassidy-hutchinson-we-need-more-people-to-step-forward-to-salvage-the-gop-220765765876\" target=\"_blank\" rel=\"noopener\">Cassidy Hutchinson<\/a> \u2014 \u201cto commit perjury and obstruct a congressional investigation.\u201d (There\u2019s no evidence to suggest Cheney and Hutchinson did so.)<\/li>\n<li>Dared New York Attorney General <a href=\"https:\/\/x.com\/mrddmia\/status\/1854623971787800714?s=46&#038;t=jt1UNwxAiaVrRd-FHFGoHg\" target=\"_blank\" rel=\"noopener\">Letitia James to \u201ccontinue [her] lawfare\u201d<\/a> because \u201cwe\u2019re not messing around this time and we will put your fat ass in prison for conspiracy against rights.\u201d<\/li>\n<li>Suggested other state and federal prosecutors who have brought cases against Trump and his allies should be prosecuted <a href=\"https:\/\/x.com\/mrddmia\/status\/1854224547287056630\" target=\"_blank\" rel=\"noopener\">\u201c[o]nly for their real crimes. Like conspiracy against rights.\u201d<\/a><\/li>\n<li>Responded to <a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/live-blog\/presidential-election-2024-live-updates-rcna175556\/rcrd63626?canonicalCard=true\" target=\"_blank\" rel=\"noopener\">NBC News\u2019 report<\/a>, based on one of his earlier posts, that Jack Smith could face \u201clegal consequences,\u201d with one sentence: \u201c<a href=\"https:\/\/x.com\/mrddmia\/status\/1854164990699151696\" target=\"_blank\" rel=\"noopener\">Fact check: True<\/a>.\u201d<\/li>\n<\/ul>\n<h2 class>Trump whisperer or just trolling the libs?<\/h2>\n<p class>Is Davis, whom Donald Trump Jr. once called \u201c<a href=\"https:\/\/www.politico.com\/news\/magazine\/2024\/09\/20\/mike-davis-trump-potential-attorney-general-profile-00179358\" target=\"_blank\" rel=\"noopener\">the tip of the spear defending my father from these corrupt prosecutors<\/a>,\u201d a human crystal ball?  Or is he just trolling the libs, a role he relishes? It\u2019s purposefully messy. As <a href=\"https:\/\/www.politico.com\/news\/magazine\/2024\/09\/20\/mike-davis-trump-potential-attorney-general-profile-00179358\" target=\"_blank\" rel=\"noopener\">Politico observed<\/a> in a profile of Davis earlier this year, he \u201cencapsulates a defining feature of conservatives in the Trump era: the dissolving barrier between reality and trolling, between serious political ideas and winking provocation.\u201d<\/p>\n<p class>Of course, even if Davis were completely serious, he has no authority to put <em>anyone <\/em>in prison, much less indict them. And no court has found any merit to his accusation that prosecutors like <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=147F1b0XaPxu8G0WLsrUOQ==\" target=\"_blank\" rel=\"noopener\">James<\/a> and <a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2023cr0257-198\" target=\"_blank\" rel=\"noopener\">Smith<\/a> have maliciously prosecuted Trump, much less violated any criminal law. <\/p>\n<p class>Asked whether Davis is under consideration for any political appointments in the next Trump White House and whether the Trump transition team and\/or the president-elect support Davis\u2019 posts, Karoline Leavitt, the spokeswoman for the transition, offered only this statement on Thursday, \u201cPresident-Elect Trump will begin making decisions on who will serve in his second Administration soon. Those decisions will be announced when they are made.\u201d<\/p>\n<p class>BLN also sought comment from Davis, asking whether he genuinely believes Smith, James and Cheney should be prosecuted and whether he was speaking for himself and A3P, or whether his views are reflective of Trump and his transition team. A3P responded with a five-word statement on behalf of Davis on Thursday: \u201cNobody is above the law.\u201d<\/p>\n<p class><a href=\"https:\/\/x.com\/mrddmia\/status\/1854911504136781936\" target=\"_blank\" rel=\"noopener\">Davis himself took to X<\/a> on Friday to reiterate his support for Trump, but announce, \u201cI am not going into his administration and am not under consideration for Attorney General.\u201d He continued, \u201cAs I have made crystal clear, I do not speak for President Trump or anyone else.\u201d <\/p>\n<p class>Still, NBC News reported Friday that while he is not leading Trump\u2019s DOJ transition efforts, Davis is indeed among those involved, citing sources familiar with the matter.<\/p>\n<p>So for my part, I intend to take Davis at his word as I watch for Trump\u2019s transition announcements to begin in the coming days. But whether or not Davis takes a job in Washington, don\u2019t count on his influence diminishing.
