That could be delayed, too."},"content":{"rendered":"<div data-testid=\"byline-container\"><a href=\"https:\/\/www.msnbc.com\/author\/jordan-rubin-ncpn1301611\"><picture data-testid=\"picture\"><source media=\"(min-width: 320px)\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_focal-60x60,f_auto,q_auto:best\/newscms\/2023_04\/3591629\/jordan_rubin_1.png\" alt height=\"48\" width=\"48\"><\/source><\/picture><\/a><\/div>\n<div>\n<p class>It wasn&rsquo;t surprising when Judge Juan Merchan on Friday postponed <a href=\"https:\/\/www.msnbc.com\/donald-trump\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a>&rsquo;s <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-sentence-date-delay-judge-merchan-ruling-rcna167215\" target=\"_blank\" rel=\"noopener\">New York state sentencing<\/a> until after the presidential election. After all, the Manhattan District Attorney&rsquo;s Office <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-sentencing-bragg-letter-merchan-rcna167165\" target=\"_blank\" rel=\"noopener\">all but agreed<\/a> with Trump&rsquo;s delay request.<\/p>\n<p class>But Merchan not only <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/PeoplevDJT-Letter-Adjournment-Dec9-6-24.pdf\" target=\"_blank\" rel=\"noopener\">set a new sentencing date<\/a> for Nov. 26, pushing it back most recently from Sept. 18. The judge also pushed back the date for ruling on Trump&rsquo;s motion to set aside his guilty verdicts <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-ruling-hush-money-case-new-york-rcna163781\" target=\"_blank\" rel=\"noopener\">based on the Supreme Court&rsquo;s immunity ruling<\/a>from Sept. 16 to Nov. 12.<\/p>\n<p class>But this new schedule risks even further delay.<\/p>\n<p class>When Trump&rsquo;s lawyers asked Merchan last month to push back the sentencing, they told him that if he ruled on Sept. 16 against Trump&rsquo;s immunity claim, then they were immediately going to seek to challenge his ruling on appeal before any sentencing could take place. &ldquo;The requested adjournment is also necessary to allow President Trump adequate time to assess and pursue state and federal appellate options in response to any adverse ruling,&rdquo; <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/2024-08-14-Letter-re-sentencing-adjournment.pdf\" target=\"_blank\" rel=\"noopener\">they wrote<\/a>adding that &ldquo;a single business day is an unreasonably short period of time for President Trump to seek to vindicate these rights.&rdquo;<\/p>\n<p class>Putting aside whether Trump&rsquo;s immunity claim in the so-called hush money case has any merit, it&rsquo;s true that, had Merchan rejected that claim on Sept. 16 while keeping the Sept. 18 sentencing, there was a good chance that that sentencing wouldn&rsquo;t have happened as scheduled. Manhattan District Attorney Alvin Bragg&rsquo;s office <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-sentencing-bragg-letter-merchan-rcna167165\" target=\"_blank\" rel=\"noopener\">effectively agreed<\/a> with that notion, writing to Merchan <a href=\"https:\/\/s3.documentcloud.org\/documents\/25050972\/2024-08-16-peoples-response-filed.pdf\" target=\"_blank\" rel=\"noopener\">last month<\/a> that:<\/p>\n<section>\n<blockquote>\n<p>Assuming that defendant seeks an interim stay of the sentencing hearing immediately after this Court&rsquo;s September 16 ruling, the People respectfully note that an appellate court considering such a request will understand that, without an interim stay, it would have to receive briefing and decide certain issues of first impression in one day.<\/p>\n<p><small><span><\/span><\/small><\/p><\/blockquote>\n<\/section>\n<p class>So it made some sense for Merchan to delay the sentencing. That is, it made sense as much as anything can after the Supreme Court&rsquo;s immunity ruling in the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-ruling-supreme-court-overview-rcna159807\" target=\"_blank\" rel=\"noopener\">federal election interference case<\/a>. That ruling <em>shouldn&rsquo;t <\/em>have called into question Trump&rsquo;s state prosecution for covering up a private hush money scheme, but here we are.<\/p>\n<p class>So the decision to push to November a ruling on Trump&rsquo;s motion to set aside his guilty verdicts means that, if Merchan rules against Trump at that point, Trump&rsquo;s appellate challenges will still need to play out; that&rsquo;s his lawyers&rsquo; stated intention, at least. There&rsquo;s now more space between that ruling and sentencing &mdash; from Sept. 16 and 18 to Nov. 12 and 26, respectively. <\/p>\n<p class>Would it take less than two weeks to address Trump&rsquo;s challenges before his state sentencing could go forward? Especially if those challenges include<strong> <\/strong>a trip to the Supreme Court, whose immunity ruling helped Trump get to this point? We won&rsquo;t know the answer until after the election &mdash; again, that&rsquo;s <em>if<\/em> Merchan rejects Trump&rsquo;s immunity claim &mdash; and much else can happen between now and then, legally and politically.<\/p>\n<p class>But whatever happens at the ballot box, we shouldn&rsquo;t carve this new sentencing date into stone just yet, <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-verdict-merchan-july-sentencing-rcna154886\" target=\"_blank\" rel=\"noopener\">however delayed it has already been<\/a>.<\/p>\n<p><strong>Subscribe to the<\/strong><a href=\"https:\/\/link.msnbc.com\/join\/5ck\/msnbc-deadlinelegal-signup-inline\" target=\"_blank\" rel=\"noopener\"><strong>Deadline: Legal Newsletter<\/strong><\/a><strong>for updates and expert analysis on the top legal stories.
