The rejection of the Republican presidential nominee&rsquo;s appeal was on the <a href=\"https:\/\/www.nycourts.gov\/ctapps\/Decisions\/2024\/Sep24\/DecisionList091224.pdf\" target=\"_blank\" rel=\"noopener\">list of motions<\/a> decided by the top court on Thursday.<\/p>\n<p class>Judge Juan Merchan had <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/donald-trump-gag-order-loosened-merchan-rcna158867\" target=\"_blank\" rel=\"noopener\">partially terminated the order<\/a> after the former president <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/read-full-text-guilty-verdict-sheet-trump-trial-pdf-rcna154807\" target=\"_blank\" rel=\"noopener\">was found guilty<\/a> in May on all 34 counts of falsifying business records in the first degree. With the trial over, Merchan ended the order&rsquo;s restrictions related to trial witnesses and the jury, but he <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/PDFs\/PostTrial-Termination-GagOrder.pdf\" target=\"_blank\" rel=\"noopener\">kept them in place<\/a> for speech targeting Manhattan District Attorney Alvin Bragg&rsquo;s staff, court staff, their family members as well as family members of Bragg and Merchan.<\/p>\n<p class>The intermediate state appeals court last month <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-gag-order-appeal-loses-new-york-rcna164697\" target=\"_blank\" rel=\"noopener\">rejected Trump&rsquo;s argument<\/a> that the trial&rsquo;s conclusion warranted terminating the order completely prior to sentencing. &ldquo;The fair administration of justice necessarily includes sentencing,&rdquo; the <a href=\"https:\/\/www.nycourts.gov\/courts\/ad1\/calendar\/List_Word\/2024\/08_Aug\/01\/PDF\/TrumpvMerchan(2024-04013).pdf\" target=\"_blank\" rel=\"noopener\">appeals court wrote<\/a>citing the limited nature of the remaining order and noting that &ldquo;threats received by District Attorney staff after the jury verdict continued to pose a significant and imminent threat.&rdquo;<\/p>\n<p class>Trump succeeded last week in getting Merchan <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-sentence-date-delay-judge-merchan-ruling-rcna167215\" target=\"_blank\" rel=\"noopener\">to postpone the sentencing<\/a> until after November&rsquo;s presidential election. When it comes to the remaining gag order, that means it stays in place for that much longer, with Thursday&rsquo;s rejection potentially being the final word on the matter. It&rsquo;s unclear if Trump will seek to appeal further to the U.S. Supreme Court, which <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-ruling-supreme-court-overview-rcna159807\" target=\"_blank\" rel=\"noopener\">gave him broad criminal immunity<\/a> in the July 1 ruling that led to his New York sentencing being postponed. <\/p>\n<p class>Merchant&#8221;https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/PeoplevDJT-Letter-Adjournment-Dec9-6-24.pdf&#8221; target=&#8221;_blank&#8221;&gt; is slated to decide on Nov. 12 whether Trump&rsquo;s Manhattan verdicts can stand <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-ruling-hush-money-case-new-york-rcna163781\" target=\"_blank\" rel=\"noopener\">in the face of the immunity decision<\/a>.
