{"id":17682,"date":"2026-01-14T05:20:19","date_gmt":"2026-01-14T05:20:19","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/trumps-fight-against-transgender-women-in-sports-lurks-in-supreme-court-appeal\/"},"modified":"2026-01-14T05:20:19","modified_gmt":"2026-01-14T05:20:19","slug":"trumps-fight-against-transgender-women-in-sports-lurks-in-supreme-court-appeal","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/trumps-fight-against-transgender-women-in-sports-lurks-in-supreme-court-appeal\/","title":{"rendered":"Trump\u2019s fight against transgender women in sports lurks in Supreme Court appeal"},"content":{"rendered":"<div>\n<p>The Supreme Court&nbsp;<a href=\"https:\/\/www.ms.now\/deadline-white-house\/deadline-legal-blog\/trans-female-athletes-best-real-hope-could-be-that-scotus-doesnt-decide-the-issue-at-all\">heard arguments Tuesday<\/a>over state bans on <a href=\"https:\/\/www.ms.now\/news\/supreme-court-trans-athletes-teen-politics\">transgender athletes<\/a> in women&rsquo;s and girls&rsquo; sports. The court&rsquo;s forthcoming rulings in the two argued cases from Idaho and West Virginia could affect similar laws in 25 other states as well.<\/p>\n<p>The court&nbsp;<a href=\"https:\/\/www.nytimes.com\/live\/2026\/01\/13\/us\/supreme-court-trans-athletes\">sounded likely<\/a>to side with the states, though the scope of the rulings, expected by July, remains to be seen.<\/p>\n<p>While we await those crucial decisions on state bans, it&rsquo;s worth considering another epic question that hummed in the background of the hearings: Can the remaining states <em>allow<\/em>transgender women and girls to compete on their chosen teams?<\/p>\n<p>The court isn&rsquo;t expected to answer that broader question in these cases. But multiple justices brought it up Tuesday, led by Justice&nbsp;<a href=\"http:\/\/www.ms.now\/applewebdata:\/\/89C96F63-0A58-4F72-99D3-BE0335D36042\/h\">Brett Kavanaugh<\/a>.<\/p>\n<p>In the Idaho case,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2025\/24-38_n75p.pdf\">Little v. Hecox<\/a>the Trump-appointed justice asked the state&rsquo;s lawyer, Alan Hurst, if the other states that let transgender women and girls play on their chosen teams are violating the Constitution&rsquo;s equal protection clause, or whether it&rsquo;s up to each state to decide. Hurst said he hadn&rsquo;t &ldquo;yet been persuaded by a constitutional theory that would let us use the Equal Protection Clause to impose our policy on other states in this matter.&rdquo;<\/p>\n<p>Yet a lawyer for the Trump administration who argued in both cases, Hashim Mooppan, noted that the federal government has been &ldquo;actively litigating&rdquo; against states that allow transgender&nbsp;sports participation &mdash; though not under equal protection but rather under federal law called Title IX that bans sex discrimination.<\/p>\n<p>During the hearing in&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2025\/24-43_n6io.pdf\">the West Virginia case<\/a>which involves Title IX, Kavanaugh raised his forward-looking concern to that state&rsquo;s lawyer, Michael Williams. The lawyer said that&nbsp;&ldquo;under equal protection, I think we agree with our friends in Idaho that there&rsquo;s enough room for California to make a different determination.&rdquo;&nbsp;But Williams said it&rsquo;s a closer question under Title IX and that the court doesn&rsquo;t need to resolve that issue about the permissive states in this case.<\/p>\n<p>When Mooppan argued again in the West Virginia case, Justices&nbsp;<a href=\"https:\/\/www.ms.now\/deadline-white-house\/deadline-legal-blog\/appeals-supreme-court-cases-tragic-rcna237541\">Sonia Sotomayor<\/a>and&nbsp;<a href=\"https:\/\/www.ms.now\/deadline-white-house\/deadline-legal-blog\/supreme-court-texas-redistricting-deadline-newsletter\">Elena Kagan<\/a>asked him about those other states, too. Kavanaugh also brought it up again, wondering aloud how California could prevail in the natural follow-up litigation. Mooppan offered an idea of what the Democratic-led state could argue, adding: &ldquo;Whether that argument is right or wrong is for another case, but I don&rsquo;t think if you adopt the argument I&rsquo;m making here today, their hands are going to be tied.&rdquo;<\/p>\n<p>When the American Civil Liberties Union&rsquo;s Joshua Block argued in favor of&nbsp;<a href=\"https:\/\/www.ms.now\/news\/supreme-court-trans-athletes-teen-politics\">Becky Pepper-Jackson<\/a>in the West Virginia case, Kavanaugh brought up the forward-looking issue yet again, calling it &ldquo;real important.&rdquo; Kagan went so far as to ask Block what the court should or shouldn&rsquo;t say in its ruling in this case if it didn&rsquo;t want to prevent states from making their own choices in future cases.<\/p>\n<p>One of the things Block said in response to Kagan was that the court doesn&rsquo;t need to define sex in this case.<\/p>\n<p>Perhaps signaling battle lines to come in that future fight, Justice Samuel Alito, who is likely to&nbsp;<a href=\"https:\/\/www.ms.now\/deadline-white-house\/deadline-legal-blog\/kagan-sotomayor-jackson-dissents-gender-affirming-care-supreme-court-rcna213800\">side against the transgender position<\/a>said Title IX prohibits discrimination on the basis of sex and so &ldquo;it must mean something.&rdquo;<\/p>\n<p><strong>Subscribe to the<\/strong><a href=\"https:\/\/link.ms.now\/join\/5ck\/msnbc-deadlinelegal-signup-inline\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Deadline: Legal Newsletter<\/strong><\/a><strong>for expert analysis on the top legal stories of the week, including updates from the Supreme Court and developments in the Trump administration&rsquo;s legal cases.<\/strong><\/p>\n<\/div>\n<div>\n<p>Jordan&nbsp;Rubin is the Deadline: Legal Blog writer.
