{"id":15044,"date":"2025-10-31T00:20:42","date_gmt":"2025-10-31T00:20:42","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/trump-administration-makes-emergency-appeal-to-supreme-court-to-fire-head-of-the-us-copyright-office\/"},"modified":"2025-10-31T00:20:42","modified_gmt":"2025-10-31T00:20:42","slug":"trump-administration-makes-emergency-appeal-to-supreme-court-to-fire-head-of-the-us-copyright-office","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/trump-administration-makes-emergency-appeal-to-supreme-court-to-fire-head-of-the-us-copyright-office\/","title":{"rendered":"Trump Administration Makes Emergency Appeal To Supreme Court To Fire Head Of The US Copyright Office"},"content":{"rendered":"<div xmlns:xlink=\"http:\/\/www.w3.org\/1999\/xlink\">\n<p>WASHINGTON (AP) &mdash; The Trump administration on Monday asked <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/us-supreme-court\">the Supreme Court<\/a><\/span>  to allow it to fire the <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/copyright-director-firing-government-trump-7ab99992a96131bce7de853b66feec68\">director of the U.S. Copyright Office.<\/a><\/span><\/p>\n<p>The administration&rsquo;s newest emergency appeal to the high court was filed a month and a half after a federal appeals court in Washington <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/media.cadc.uscourts.gov\/orders\/docs\/2025\/09\/25-5285LDSN2.pdf\" target=\"_blank\" rel=\"noopener\">held that the official<\/a><\/span>Shira Perlmutter, could not be unilaterally fired. <\/p>\n<p>Nearly four weeks ago, the full U.S. Court of Appeals for the District of Columbia Circuit refused to reconsider that ruling.<\/p>\n<p>The case is the latest that relates to Trump&rsquo;s authority to install his own people at the head of federal agencies. The Supreme Court has largely allowed Trump to fire officials, even as court challenges proceed.<\/p>\n<p>But this case concerns an office that is within <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/library-of-congress\">the Library of Congress<\/a><\/span>. Perlmutter is the register of copyrights and also advises Congress on copyright issues. <\/p>\n<p>Solicitor General D. (AP Photo\/Mariam Zuhaib)<\/p>\n<p>                        <\/bsp-carousel-read-more>                    <\/div>\n<p>    <\/template>    <\/bsp-figure>                <\/div>\n<p>Perlmutter claims Trump fired her in May because he disapproved of advice she gave to Congress in <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ai-copyright-office-artificial-intelligence-363f1c537eb86b624bf5e81bed70d459\">a report related to artificial intelligence<\/a><\/span>. Perlmutter had received an email from the White House notifying her that &ldquo;your position as the Register of Copyrights and Director at the U.S. Copyright Office is terminated effective immediately,&rdquo; her office said.<\/p>\n<p>A divided appellate panel ruled that Perlmutter could keep her job while the case moves forward.<\/p>\n<p>&ldquo;The Executive&rsquo;s alleged blatant interference with the work of a Legislative Branch official, as she performs statutorily authorized duties to advise Congress, strikes us as a violation of the separation of powers that is significantly different in kind and in degree from the cases that have come before,&rdquo; Judge Florence Pan wrote for the appeals court. Judge Michelle Childs joined the opinion. Democratic President Joe Biden appointed both judges to the appeals court.<\/p>\n<p>Judge Justin Walker, a Trump appointee, wrote in dissent that Perlmutter &ldquo;exercises executive power in a host of ways.&rdquo;<\/p>\n<p><span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.280893\/gov.uscourts.dcd.280893.2.1.pdf\" target=\"_blank\" rel=\"noopener\">Perlmutter&rsquo;s attorneys<\/a><\/span>  have argued that she is a renowned copyright expert. She has served as register of copyrights since <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-library-of-congress-carla-hayden-20a1862ce6d2e0d51a84a37b264ce2ef\">then-Librarian of Congress Carla Hayden<\/a><\/span>  appointed her to the job in October 2020.<\/p>\n<p>Trump appointed <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-library-congress-todd-blanche-carla-hayden-cc2154fa8644a5c29d196e505e4faa51\">Deputy Attorney General Todd Blanche<\/a><\/span>  to replace Hayden at the Library of Congress.
