Yet, when it comes to Trump&rsquo;s birthright citizenship order, the administration has taken a more leisurely approach that <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/birthright-citizenship-constitution-supreme-court-deadline-newsletter-rcna208747\">suggests a lack of confidence<\/a> in what even this Supreme Court would say if pressed to rule on the order&rsquo;s legality. <\/p>\n<p id=\"anchor-76435c\">But now the administration <a href=\"https:\/\/www.scotusblog.com\/2025\/09\/trump-urges-supreme-court-to-decide-whether-to-end-birthright-citizenship\/\">has finally asked<\/a> the high court to weigh in on the merits of Trump&rsquo;s order, which effectively <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-birthright-citizenship-hearing-trump-rcna207077\">aimed to unilaterally rewrite<\/a> the Constitution, law and precedent &mdash; or at the very least, the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/native-american-birthright-citizenship-ask-jordan-rcna211410\">long-held understanding<\/a> of those things. <\/p>\n<p id=\"anchor-d73fb9\">With this new appeal, the justices could choose to add the fate of birthright citizenship to their docket for <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-next-term-big-cases-voting-rights-rcna223601\">the new term<\/a> that starts next week, with a decision due by the summer. We should learn later this year whether they will do so.<\/p>\n<p id=\"anchor-b82921\">The Supreme Court recently ruled in <em>a <\/em>birthright citizenship case <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/birthright-citizenship-supreme-court-hearing-trump-rcna206827\" target=\"_blank\">but not <em>on<\/em> birthright citizenship<\/a>. When it pressed that appeal, the administration urged the justices <em>not<\/em> to rule on the merits of whether Trump&rsquo;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\">proposed citizenship restrictions<\/a> were lawful; rather, it asked them only to impose stricter conditions on lower court judges<strong> <\/strong>issuing broad injunctions when blocking government policies. It&rsquo;s an important procedural issue that applies in all sorts of litigation but it arose in the context of the birthright citizenship litigation, too.  <\/p>\n<p id=\"anchor-774dce\">The high court majority <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-birthright-citizenship-ruling-injunctions-trump-rcna207129\">issued the procedural ruling<\/a> the administration wanted in June. But that still left open the underlying question of the order&rsquo;s legality.<strong> <\/strong>After <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-birthright-citizenship-casa-rcna220798\">losing the latest round<\/a> of litigation again in the lower courts, the administration has now returned to the justices, asking them to &ldquo;confirm the original meaning of the Citizenship Clause.&rdquo; That clause of the 14th Amendment, which has <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/birthright-citizenship-trump-supreme-court-ask-jordan-rcna209933\" target=\"_blank\">long been understood<\/a> to grant automatic citizenship to people born on U.S. soil, says: &ldquo;All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.&rdquo;<\/p>\n<p id=\"anchor-f9a6c6\">Again, the administration could have asked for such a ruling months ago, instead of first seeking the procedural ruling it pressed in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a884_8n59.pdf\" target=\"_blank\">Trump v. CASA<\/a>. The administration has not been shy about <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-emergency-docket-deadline-newsletter-rcna215906\" target=\"_blank\">ringing up the justices<\/a> when it has felt the need to do so. In any event, we are now closer to the justices finally deciding the matter.
