{"id":13788,"date":"2025-09-27T11:20:22","date_gmt":"2025-09-27T11:20:22","guid":{"rendered":"https:\/\/bluelightnews.com\/category\/politics\/supreme-court-backs-trump-on-withholding-billions-in-foreign-aid\/"},"modified":"2025-09-27T11:20:22","modified_gmt":"2025-09-27T11:20:22","slug":"supreme-court-backs-trump-on-withholding-billions-in-foreign-aid","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/supreme-court-backs-trump-on-withholding-billions-in-foreign-aid\/","title":{"rendered":"Supreme Court backs Trump on withholding billions in foreign aid"},"content":{"rendered":"<div data-testid=\"byline-container\"><a href=\"https:\/\/www.msnbc.com\/author\/jordan-rubin-ncpn1301611\" tabindex=\"-1\"><picture data-testid=\"picture\" data-flavor=\"focal\" data-original-height=\"48\" data-original-width=\"48\"><source media=\"(min-width: 320px)\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_focal-60x60,f_auto,q_auto:best\/newscms\/2023_04\/3591629\/jordan_rubin_1.png\" alt height=\"48\" width=\"48\"><\/source><\/picture><\/a><\/div>\n<div>\n<p id=\"anchor-864984\">The <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-los-angeles-roving-patrols-emergency-relief-trump-rcna224611\">Supreme Court <\/a>will let the<a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-justice-department-lost-benefit-doubt-judges-rcna228763\"> Trump administration<\/a> withhold $4 billion in congressionally approved foreign aid, in the Republican-appointed majority&rsquo;s latest shadow docket win delivered to President Donald Trump.<\/p>\n<p id=\"anchor-1fb91d\"><a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/25a269_bp7c.pdf\" target=\"_blank\">The order<\/a> Friday was issued over dissent from the court&rsquo;s three Democratic appointees, who wrote that &ldquo;the effect of its ruling is to allow the Executive to cease obligating $4 billion in funds that Congress appropriated for foreign aid, and that will now never reach its intended recipients.&rdquo;<\/p>\n<p id=\"anchor-7dfc1c\">In a brief order, the majority said the government met the standard for urgent preliminary relief, though it emphasized that Friday&rsquo;s order &ldquo;should not be read as a final determination on the merits.&rdquo; In her dissent for the three Democratic appointees, Justice Elena Kagan wrote that she appreciated &ldquo;that the majority refrains from offering a definitive view of this dispute and the questions raised in it,&rdquo; but she nonetheless took stock of the weighty consequences of the order, arguing that the result &ldquo;conflicts with the separation of powers.&rdquo; <\/p>\n<p id=\"anchor-7739e6\"><a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-ftc-commissioner-fire-cause-trump-rcna231388\" target=\"_blank\">Continuing her criticism<\/a> of the majority&rsquo;s actions and how it takes them on the emergency docket, Kagan wrote that emergency relief &ldquo;should be sparingly given,&rdquo; as she noted that &ldquo;every such award disrupts the usual process of judicial review.&rdquo;<\/p>\n<p id=\"anchor-7c434f\">On Sept. 8, the administration appealed to Chief Justice <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/john-roberts-doge-records-supreme-court-crew-rcna208307\">John Roberts<\/a>who handles emergency appeals from Washington courts, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A269\/373945\/20250908080903468_GHC_Application_9.8_Final.pdf\">seeking immediate relief<\/a> from an order to pay certain congressionally appropriated funding. Plaintiffs who had sued the administration opposed such high court relief, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A269\/373960\/20250908103041504_25A269OpptoRequestforAdminStay.pdf\">writing that <\/a>the government was only being ordered to comply with the law, and that granting even temporary relief could &ldquo;result in the impoundment of billions of dollars in funds.&rdquo;<\/p>\n<p id=\"anchor-c622ff\">Roberts nonetheless <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-roberts-foreign-aid-rcna230095\">granted that temporary relief<\/a> a day later, issuing what&rsquo;s known as an administrative stay while the full court considered the issue.
