Or does this horrible immunity decision make that impossible?&rdquo; <\/strong><\/p>\n<p class>&mdash; Lisa Ruml, Dover, New Jersey<\/p>\n<p class>Hi Lisa,<\/p>\n<p class>Yes, the current Supreme Court could (and likely would) say that such a law is unconstitutional. While I agree with you that the <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-immunity-roberts-court-rcna164239\" target=\"_blank\" rel=\"noopener\">immunity ruling<\/a> in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\" rel=\"noopener\">Trump v. United States<\/a> was unfounded, the Supreme Court is nonetheless seen as the decider of constitutional meaning. With that in mind, the ruling takes issue with your premise that there&rsquo;s nothing in the Constitution about immunity, because the court framed <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/ketanji-brown-jackson-immunity-ruling-trump-rcna168578\" target=\"_blank\" rel=\"noopener\">its decision<\/a> against the backdrop of &ldquo;our constitutional structure of separated powers.&rdquo;<\/p>\n<p class>To be sure, there are situations where Congress can override a Supreme Court ruling by passing a law. If there&rsquo;s a decision about what a law means (as opposed to what the Constitution means), Congress can pass a new law addressing that ruling. For example, then-President Barack Obama signed into law the 2009 <a href=\"https:\/\/www.eeoc.gov\/statutes\/notice-concerning-lilly-ledbetter-fair-pay-act-2009\" target=\"_blank\" rel=\"noopener\">Lilly Ledbetter Fair Pay Act<\/a>which overrode a <a href=\"https:\/\/scholar.google.com\/scholar_case?case=16533088912171823433&amp;q=Ledbetter+v.+Goodyear+Tire+and+Rubber+Company&amp;hl=en&amp;as_sdt=6,47\" target=\"_blank\" rel=\"noopener\">2007 case<\/a> that was decided on statutory (not constitutional) grounds. The late Justice Ruth Bader Ginsburg had noted in her 2007 dissent that&nbsp;&ldquo;the ball is in Congress&rsquo; court&rdquo; &mdash; and Congress acted.<\/p>\n<p class>The political response to the immunity ruling highlights this reality. The background I laid out above is probably the reason that President <a href=\"https:\/\/www.msnbc.com\/joe-biden\" target=\"_blank\" rel=\"noopener\">Joe Biden&rsquo;s<\/a> <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/07\/29\/fact-sheet-president-biden-announces-bold-plan-to-reform-the-supreme-court-and-ensure-no-president-is-above-the-law\/\" target=\"_blank\" rel=\"noopener\">court reform support<\/a> includes a constitutional amendment saying former presidents aren&rsquo;t immune from prosecution, as opposed to a regular law saying so. An amendment is of course <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-reform-biden-constitutional-amendment-immunity-rcna164042\" target=\"_blank\" rel=\"noopener\">more difficult to accomplish<\/a>though it has happened <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/articles\/article-v\/interpretations\/277\" target=\"_blank\" rel=\"noopener\">27 times before<\/a> &mdash; with agreement of two-thirds of the House and Senate, plus three-quarters of the states.<\/p>\n<p class><strong>More from &lsquo;Ask Jordan&rsquo;: <\/strong><a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/what-happens-trumps-legal-cases-2024-election-ask-jordan-rcna158326\" target=\"_blank\" rel=\"noopener\"><em>What happens in Trump&rsquo;s cases if he loses the election?<\/em><\/a>  <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-trial-constitution-speedy-trial-rcna156047\" target=\"_blank\" rel=\"noopener\"><em>Does the public have a right to speedy trials against Trump?<\/em><\/a>  <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/trump-trials-self-pardon-dismiss-cases-rcna153957\" target=\"_blank\" rel=\"noopener\"><em>Is Trump really above the law?<\/em><\/a><\/p>\n<p class>Another long-shot way to overturn the immunity ruling is for the court to do so directly. Absent an unlikely change of heart by the current justices, that would hinge on a new court composition, which could take years to happen, if it ever does. The <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/maddowblog\/supreme-court-overturns-roe-v-wade-rcna35190\" target=\"_blank\" rel=\"noopener\">2022 Dobbs ruling<\/a> overturning 1973&rsquo;s Roe v. Wade was the product of a decades-long conservative legal movement push to remake the courts. Dobbs has likewise sparked a backlash, but whether it prompts a movement that remakes the Supreme Court remains to be seen.
