So as with nearly every big issue in American life, <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/lisa-cook-supreme-court-travel-ban-donald-trump-rcna228071\">the justices may have the last word<\/a>.<\/p>\n<p id=\"anchor-3d61ae\">Attorney General Pam Bondi <a href=\"https:\/\/x.com\/AGPamBondi\/status\/1961568926862610761\" target=\"_blank\">said the administration<\/a> will appeal. The president said in his own <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115114339832960282\" target=\"_blank\">social media post<\/a> that if the ruling stands it would &ldquo;literally destroy the United States of America.&rdquo;<\/p>\n<p id=\"anchor-6335d5\"><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cafc.23105\/gov.uscourts.cafc.23105.159.0.pdf\">The ruling<\/a> came Friday from the U.S. Court of Appeals for the Federal Circuit. It dealt with five executive orders imposing tariffs &ldquo;of unlimited duration on nearly all goods from nearly every country in the world,&rdquo; as the court put it. The U.S. Court of International Trade had previously ruled in May that the tariffs ran afoul of a federal law called the International Emergency Economic Powers Act (IEEPA). The government appealed to the Federal Circuit, which upheld the trade court on Friday.<\/p>\n<p id=\"anchor-623199\">&ldquo;Because we agree that IEEPA&rsquo;s grant of presidential authority to &lsquo;regulate&rsquo; imports does not authorize the tariffs imposed by the Executive Orders, we affirm,&rdquo; the appeals court said, adding that it wasn&rsquo;t weighing in on &ldquo;whether the President&rsquo;s actions should have been taken as a matter of policy.&rdquo;<\/p>\n<p id=\"anchor-bfe6de\">The court also said that further review is needed back in the trade court regarding the universal injunction it granted. The appeals court cited the Supreme Court&rsquo;s ruling in <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-birthright-citizenship-ruling-injunctions-trump-rcna207129\">the birthright citizenship case<\/a> that dealt with that subject in June, after the trade court ruling came out.<\/p>\n<p id=\"anchor-7f41db\">The Federal Circuit&rsquo;s ruling on Friday split the 11 judges who heard the case 7-4.<\/p>\n<p id=\"anchor-2df9df\">The judges also <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cafc.23105\/gov.uscourts.cafc.23105.161.0.pdf\">issued an order<\/a> accompanying the ruling that keeps it from taking effect through Oct. 14.
