{"id":1225,"date":"2024-11-11T19:01:32","date_gmt":"2024-11-11T19:01:32","guid":{"rendered":"https:\/\/bluelightnews.com\/doj-says-jack-smiths-delay-in-trump-case-is-no-reason-to-do-the-same-for-jan-6-defendants\/"},"modified":"2024-11-11T19:01:32","modified_gmt":"2024-11-11T19:01:32","slug":"doj-says-jack-smiths-delay-in-trump-case-is-no-reason-to-do-the-same-for-jan-6-defendants","status":"publish","type":"post","link":"https:\/\/bluelightnews.com\/category\/politics\/doj-says-jack-smiths-delay-in-trump-case-is-no-reason-to-do-the-same-for-jan-6-defendants\/","title":{"rendered":"DOJ says Jack Smith\u2019s delay in Trump case is no reason to do the same for Jan. 6 defendants"},"content":{"rendered":"<div>\n<p>Special counsel Jack Smith\u2019s decision to pause his prosecution of President-elect Donald Trump is no reason to do the same for members of the mob that attacked the Capitol on Jan. 6, 2021, the Justice Department argued Monday.<\/p>\n<p>Several Jan. 6 defendants have used Smith\u2019s <a href=\"https:\/\/www.politico.com\/news\/2024\/11\/08\/jack-smith-donald-trump-charges-00188461\" target=\"_blank\" rel=\"noopener\">call for a three-week breather<\/a> \u2014 quickly endorsed by U.S. District Judge Tanya Chutkan \u2014 as proof that all criminal cases connected to the Jan. 6 attack deserve a similar slowdown.<\/p>\n<p>\u201cTo deny this motion, in the face of the Justice Department\u2019s official position [in the Trump case], would run contrary to the interests of justice and likely subject the defendant to criminal convictions for no purpose other than expediency,\u201d <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.265905\/gov.uscourts.dcd.265905.59.0.pdf\" target=\"_blank\" rel=\"noopener\">argued William Shipley<\/a>, an attorney for Jan. 6 defendant Stephen Baker, who was set to begin a trial in his case Tuesday.<\/p>\n<p>Prosecutors <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.265905\/gov.uscourts.dcd.265905.60.0_1.pdf\" target=\"_blank\" rel=\"noopener\">responded Monday<\/a>, saying Trump\u2019s case was unique and not indicative of the government\u2019s position in other Jan. 6 cases.<\/p>\n<p>\u201cThere is a public interest in the prompt and efficient administration of justice. The government and the Court have endeavored to deliver that interest,\u201d Assistant U.S Attorney Isia Jasiewicz wrote in a response to Baker\u2019s request.<\/p>\n<p>\u201cThe defendant\u2019s citation to Special Counsel Jack Smith\u2019s motion to vacate a briefing schedule in the matter of United States v. Trump \u2026 is inapposite,\u201d she wrote. \u201cThat motion refers to the \u2018unprecedented circumstance\u2019 of a criminal defendant being \u2018expected to be certified as President-elect on January 6, 2025, and inaugurated on January 20, 2025.\u2019 The need to \u2018determine the appropriate course going forward consistent with Department of Justice policy,\u2019 is not similarly implicated in this case, where the defendant is a private citizen.\u201d<\/p>\n<p>A slew of Jan. 6 defendants have begun to try to <a href=\"https:\/\/www.politico.com\/live-updates\/2024\/11\/06\/2024-election-results-live-coverage-updates-analysis\/trumps-jan-6-pardon-pledge-00187864\" target=\"_blank\" rel=\"noopener\">delay their cases<\/a> as they wait to see if Trump follows through on his broad promise to pardon them.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Special counsel Jack Smith\u2019s decision to pause his prosecution of President-elect Donald Trump is no reason to do the same for members of the mob that attacked the Capitol on Jan. 6, 2021, the Justice Department argued Monday.
