Andy Ogles, R-Tenn., the administration appears to be revving up its denaturalization plans.<\/p>\n<p id=\"anchor-f655a5\"><a href=\"https:\/\/www.npr.org\/2025\/06\/30\/nx-s1-5445398\/denaturalization-trump-immigration-enforcement\" target=\"_blank\">NPR reported<\/a> Monday on a Justice Department <a href=\"https:\/\/www.justice.gov\/civil\/media\/1404046\/dl?inline\" target=\"_blank\">memo from June 11<\/a>which advises prosecutors in the DOJ&rsquo;s Civil Division to prioritize the denaturalization of various naturalized citizens over alleged infractions ranging from war crimes to &ldquo;material misrepresentations&rdquo; in their citizenship applications.<\/p>\n<p id=\"anchor-8bdad0\">In his first term, Trump <a href=\"https:\/\/www.acslaw.org\/expertforum\/trump-administration-seeks-to-strip-more-people-of-citizenship\/\" target=\"_blank\">expanded former President Barack Obama&rsquo;s denaturalization policies.<\/a> An expert told NPR why the new memo&rsquo;s call to use civil litigation for this effort is particularly disturbing: <\/p>\n<section id=\"anchor-22225b\">\n<blockquote cite>\n<p>The DOJ memo says that the federal government will pursue denaturalization cases via civil litigation &mdash; an especially concerning move, said Cassandra Robertson, a law professor at Case Western Reserve University. In civil proceedings, any individual subject to denaturalization is not entitled to an attorney, Robertson said; there is also a lower burden of proof for the government to reach, and it is far easier and faster to reach a conclusion in these cases. Robertson says that stripping Americans of citizenship through civil litigation violates due process and infringes on the rights guaranteed by the 14th Amendment.<\/p>\n<p><small><span><\/span><\/small><\/p><\/blockquote>\n<\/section>\n<p id=\"anchor-35fbc2\">On the heels of Friday&rsquo;s<a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/supreme-court-birthright-citizenship-ruling-injunctions-trump-rcna207129\" target=\"_blank\"> Supreme Court ruling <\/a>in the birthright citizenship case &mdash; which undercut lower courts&rsquo; ability to <a href=\"https:\/\/www.msnbc.com\/the-beat-with-ari\/watch\/-lawlessness-will-flourish-scotus-justice-issues-chilling-warning-after-major-ruling-242399813571\" target=\"_blank\">stop the executive branch<\/a> from pursuing policies of disputed legality &mdash; it&rsquo;s safe to wonder whether and how the administration might wield its powers to target <em>more<\/em> Americans.<\/p>\n<p id=\"anchor-a8be88\">The DOJ memo asserts a broad latitude for interpretation as to what conduct might warrant denaturalization proceedings against a citizen. It lays out a list of transgressions, including torture and human trafficking, but also calls on the DOJ&rsquo;s Civil Division to target &ldquo;an individual that either &lsquo;illegally procured&rsquo; naturalization or procured naturalization by &lsquo;concealment of a material fact or by willful misrepresentation&rsquo;&rdquo; and, rather vaguely, &ldquo;individuals who pose a potential danger to national security.&rdquo; The memo also prioritizes the ominously open-ended &ldquo;any other cases &#8230; that the Division determines to be sufficiently important to pursue.&rdquo;<\/p>\n<p id=\"anchor-e69aec\">Given that Trump has labeled critics as <a href=\"https:\/\/www.politifact.com\/article\/2024\/oct\/30\/trump-is-talking-more-about-the-enemy-from-within\/\" target=\"_blank\">the &ldquo;enemy within,&rdquo;<\/a> has falsely framed <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/judge-says-trump-administration-must-release-columbia-protester-khalil-but-has-days-to-appeal\" target=\"_blank\">peaceful demonstrators<\/a> as accomplices to terrorism and has declared his ambition to <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-floats-legally-questionable-proposal-deport-us-citizens-rcna201183\" target=\"_blank\">deport American citizens to foreign prisons<\/a>the potential for abuse here seems <em>incredibly <\/em>high.<\/p>\n<\/div>\n<div data-activity-map=\"expanded-byline-article-bottom\">\n<div data-testid=\"byline-thumbnail\"><a href=\"https:\/\/www.msnbc.com\/author\/jahan-jones-ncpn371241\" tabindex=\"-1\"><picture data-testid=\"picture\"><source media=\"(min-width: 320px)\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_focal-60x60,f_auto,q_auto:best\/newscms\/2021_37\/3505463\/jahan-jones-msnbc_1.png\" alt height=\"48\" width=\"48\"><\/source><\/picture><\/a><\/div>\n<p><span data-testid=\"byline-name\"><a href=\"https:\/\/www.msnbc.com\/author\/jahan-jones-ncpn371241\"> Ja&#8217;han Jones<\/a><\/span><span><a href=\"https:\/\/x.com\/_Jahan\" target=\"_blank\" rel=\"noopener noreferrer\"><span><\/span><\/a><\/span><\/p>\n<p>Ja&rsquo;han Jones is an BLN opinion blogger.
