Militarized federal agents, often in a confusingly <a href=\"https:\/\/www.msnbc.com\/top-stories\/latest\/trump-immigration-deportation-secret-police-rcna211478\">ramshackle assortment<\/a> of gear and uniforms, have been <a href=\"https:\/\/www.npr.org\/2025\/06\/06\/nx-s1-5425524\/ice-raids-grow-tense-as-protesters-confront-immigration-agents\">met by angry crowds <\/a>shouting them down with <a href=\"https:\/\/www.youtube.com\/shorts\/I0kq0mP22gU\">chants of &ldquo;shame!&rdquo;<\/a> Over the weekend in Los Angeles, the federal government for the first time <a href=\"https:\/\/www.history.com\/this-day-in-history\/march-20\/lbj-sends-federal-troops-to-alabama\">since 1965<\/a> deployed the National Guard <a href=\"https:\/\/www.nbcnews.com\/politics\/trump-administration\/california-democrats-push-back-trumps-decision-mobilize-national-guard-rcna211718\">over the objection<\/a> of a state&rsquo;s governor. President Donald Trump &#8220;is sending 2,000 National Guard troops into LA County &mdash; not to meet an unmet need, but to manufacture a crisis,&rdquo; Gov. Gavin Newsom said on X on Sunday. &ldquo;He&rsquo;s hoping for chaos so he can justify more crackdowns, more fear, more control.&rdquo;<\/p>\n<p id=\"anchor-81fb8b\">The division and disorder on display are the culmination of an absurd premise which has long gone unchallenged: the whole concept of immigration restriction. This policy of segregation by place of birth presents a choice between three basic options. You can muddle along with de facto nonenforcement, putting swaths of the population and economy into a legal gray area and creating underground black markets. You can take the Trumpian tact of aggressive enforcement against millions of people, at the cost of civil liberties and social peace. Or you can confront the elephant in the room: the reality that these laws are unjust, unnecessary and an affront to the freedom of not just immigrants, but also citizens and our democratic republic. Mass removal is a profoundly unnatural fit for a country purporting to be free.<\/p>\n<p>When the government sends paramilitary-style law enforcement units into people&rsquo;s neighborhoods, this is no longer some abstract argument about &ldquo;the border.&rdquo;<\/p>\n<p id=\"anchor-c42b5a\">Mass deportation and large-scale immigration enforcement require nothing less than a police state, and the more of a crackdown you demand, the more obviously it will look and act like a police state. When the government sends paramilitary-style law enforcement units into people&rsquo;s neighborhoods, this is no longer some abstract argument about &ldquo;the border.&rdquo; It&rsquo;s Boyle Heights. It&rsquo;s Queens. It&rsquo;s Milwaukee. It&rsquo;s San Ysidro. It&rsquo;s armored vehicles and flash-bangs outside your grocery store.<\/p>\n<p id=\"anchor-ec84c3\">The administration&rsquo;s <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/stephen-miller-due-process-immigrants-wrong-rcna205074\">frequent line<\/a> &mdash; including from <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/5\/11\/is-due-process-different-for-undocumented-immigrants-as-trump-claims\">Trump himself<\/a> &mdash; is that only United States citizens possess legal and constitutional rights, such as due process. This is wrong as a matter of law and at best dubious as a matter of morality. Making the mere entry and presence of people illegal, turning millions who&rsquo;ve committed no other offense into marginalized outlaws, undermines the foundations of a free society. <\/p>\n<p id=\"anchor-7f0f23\">But suppose, for argument&rsquo;s sake, you care only about the freedoms of native-born Americans. Any attempt to seriously enforce restrictionist immigration laws impinges on <em>your <\/em>liberties. The enforcement of such a sweeping prohibition, the division of society it entails, can only be accomplished with a massive enforcement machine to match. And citizens <a href=\"https:\/\/www.aclu.org\/press-releases\/federal-court-rules-in-favor-of-u-s-citizen-illegally-detained-for-deportation-by-florida-sheriff\">can be<\/a>, and <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/may\/24\/us-citizen-detained-ice-real-id\">frequently are<\/a>, caught up in that machine&rsquo;s <a href=\"https:\/\/nymag.com\/intelligencer\/article\/tracking-us-citizens-children-detained-deported-ice-trump-updates.html\">grinding gears<\/a>. <\/p>\n<p id=\"anchor-002dcc\">Those horrified by the more physical means of enforcement may imagine that other, less direct methods can be sufficient to &ldquo;secure the border.&rdquo; But policymakers have attempted for decades to impose administrative barriers to accomplish the exclusionary goal with fewer actual arrests. <\/p>\n<p id=\"Anchor-C35B7B\">All 50 states now issue REAL ID-compliant identity cards, which are checked constantly in daily life. E-Verify, tenant screenings, banking rules and benefit restrictions are all burdens created to make undocumented life less desirable in hopes that people will simply leave of their own accord. Yet, millions remain, because even such burdens pale in comparison to tin-pot dictatorships, civil war or simply grinding poverty. When the paperwork fails, the boots arrive.<\/p>\n<p id=\"anchor-3da0b8\">To make mass deportation a reality, the government inevitably must send militarized agents into peaceful neighborhoods to <a href=\"https:\/\/news.northeastern.edu\/2018\/01\/19\/how-the-7-eleven-immigration-raids-feed-on-fear\/\">sweep up<\/a> cashiers, <a href=\"https:\/\/www.washingtonpost.com\/immigration\/2025\/06\/08\/ice-los-angeles-home-depot-raid-trump\/\">day laborers<\/a> and <a href=\"https:\/\/brooklyneagle.com\/articles\/2025\/01\/30\/domestic-workers-shaken-by-ice-raids-in-crown-heights\/\">housekeepers<\/a>. It must <a href=\"https:\/\/www.bbc.com\/news\/videos\/clygjlgzll3o\">unleash tear gas<\/a> and <a href=\"https:\/\/www.bbc.com\/news\/videos\/clygjlgzll3o\">violence in the streets<\/a> when communities push back against raids on <a href=\"https:\/\/www.arlnow.com\/2025\/03\/26\/i-was-paralyzed-with-fear-ashton-heights-residents-respond-to-ice-raid\/\">apartment buildings<\/a> and <a href=\"https:\/\/www.facebook.com\/watch\/?v=724996213370462\">local restaurants<\/a>. It must intrude on <a href=\"https:\/\/www.texastribune.org\/2025\/06\/04\/texas-immigration-raid-hays-county-austin-venezuelan-gang\/\">personal relationships<\/a> and <a href=\"https:\/\/www.npr.org\/2025\/04\/08\/g-s1-59056\/irs-dhs-information-sharing-deal-immigrants-tax-records\">violate privacy<\/a>, freedom of association and economic liberty. It must <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/apr\/26\/trump-administration-child-deportation\">tear away<\/a> parents, traumatize <a href=\"https:\/\/www.nbcnews.com\/news\/latino\/us-citizen-family-traumatized-ice-raid-rcna203700\">innocent kids<\/a> and <a href=\"https:\/\/nipnlg.org\/work\/resources\/setting-record-straight-about-sanctuary-policies-response-threats-against-sanctuary\">shred trust<\/a> in the law. <\/p>\n<p>These destructive social dynamics always show up in the context of enforcing victimless offenses. <\/p>\n<p id=\"anchor-eb6d4f\">To keep the assembly line of deportations moving, the government needs to trample due process with the truncated procedures offered by executive branch <a href=\"https:\/\/docs.house.gov\/meetings\/JU\/JU01\/20220120\/114339\/HHRG-117-JU01-20220120-SD007.pdf\">immigration courts<\/a>, created to sidestep the independence of <a href=\"https:\/\/www.americanbar.org\/advocacy\/governmental_legislative_work\/publications\/washingtonletter\/feb-22-wl\/article-i-courts-0222wl\/\">regular federal courts<\/a>. It <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/fbi-field-offices-ordered-shift-agents-immigration-crackdown-rcna206859\">diverts law enforcement<\/a> agencies from chasing real criminals. And it <a href=\"https:\/\/www.washingtonpost.com\/immigration\/2025\/05\/23\/house-gop-budget-immigration\/\">wastes tax money<\/a> and <a href=\"https:\/\/unidosus.org\/blog\/2024\/12\/06\/the-economic-costs-of-mass-deportations-of-long-time-residents\/\">sabotages the economy<\/a> &mdash; all to no real benefit nothing except <a href=\"https:\/\/messaging-custom-newsletters.nytimes.com\/dynamic\/render?isViewInBrowser=true&amp;paid_regi=1&amp;uri=nyt%3A%2F%2Fnewsletter%2F849a965e-ff7d-557e-a60f-657a9d585a18\">morally repellent<\/a> abstractions about <a href=\"https:\/\/www.splcenter.org\/resources\/hatewatch\/stephen-millers-affinity-white-nationalism-revealed-leaked-emails\/\">bloodlines and race<\/a>. <\/p>\n<p id=\"anchor-0b34f5\">These destructive social dynamics always show up in the context of enforcing victimless offenses. Aside from marijuana use (another absurdly unenforceable federal prohibition), undocumented presence is probably America&rsquo;s most common victimless offense &mdash; unlike violent crimes or property crimes, which <a href=\"https:\/\/www.cato.org\/blog\/new-cato-research-shows-illegal-immigrants-are-less-likely-be-convicted-murder-texas\">immigrants commit<\/a> at <a href=\"https:\/\/www.npr.org\/2024\/03\/08\/1237103158\/immigrants-are-less-likely-to-commit-crimes-than-us-born-americans-studies-find\">a lower rate<\/a> than native-born Americans, and which can and should be prosecuted in their own right. Claims about drains on resources ignore their real economic contributions <a href=\"https:\/\/taxpolicycenter.org\/fiscal-facts\/yes-undocumented-immigrants-pay-taxes-and-receive-few-tax-benefits\">to the tax base<\/a> and <a href=\"https:\/\/www.cbpp.org\/blog\/immigrants-contribute-greatly-to-the-social-security-trust-funds-solvency\">exclusion from benefits<\/a>. Social Security, for example, is <a href=\"https:\/\/www.cbpp.org\/blog\/immigrants-contribute-greatly-to-the-social-security-trust-funds-solvency\">actually subsidized<\/a> by immigrants, including undocumented immigrants who still pay taxes.  <\/p>\n<p id=\"anchor-a8db19\">There is one truth on the other side of the equation: it is indeed corrosive to have laws on the books which go unenforced and widely flouted. That has been the reality of our immigration regime for far too long. But we now see that the solution isn&rsquo;t to tear apart our society while trying to enforce bad laws. Instead, we should repeal them. Every time we ban peaceful, voluntary conduct &mdash; crossing a border, renting a home, taking a job &mdash; we expand government power and shrink liberty. The trade-off is unavoidable.<\/p>\n<p id=\"anchor-76e73a\">Across history, one of the main arcs of moral progress has been the advancement of legal equality regardless of arbitrary, immutable characteristics. Nothing is more <a href=\"https:\/\/reason.com\/volokh\/2018\/10\/23\/the-importance-of-making-the-moral-case\/\">arbitrary or immutable<\/a> than your place of birth or whom you were born to. Our civic creed insists all are created equal. Anything else shackles us all to illiberal impositions and societal dysfunction. <\/p>\n<p id=\"anchor-0335c7\">Push hard enough on mass deportation and Americans will meet ICE with <a href=\"https:\/\/cbs12.com\/news\/nation-world\/ice-tries-to-bring-man-in-custody-neighbors-form-human-chain-to-let-them-get-home\">human chains<\/a> to protect their neighbors. Tear apart people&rsquo;s lives and communities, and they will start to fight back. Try to commandeer regular police, and states and localities will refuse. Produce endless horror stories and scenes of dystopian authoritarianism, and you can&rsquo;t keep pretending this is merely about building a wall through the desert. <\/p>\n<p id=\"anchor-b69736\">This has never been about just controlling the border, it&rsquo;s about controlling America, and at the end of the day Americans are not a people who like to be controlled. The reconstruction of a post-Trump America will require a radical liberalization of immigration laws.
